IN THE SUPREME COURT OF NEW ZEALAND, OTAGO AND SOUTHLAND DISTRICT. No. 1445.

VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith:

To George Turnbull, of Dunedin in the Province of Otago, New Zealand, Merchant; and Frederick Joseph Moss, of Dunedin aforesaid, Merchant.

WHEREAS an action is now pending in our Supreme Court of New Zealand, Otago and Southland District between John Thomas Wright and Robert Miller Robertson, carrying on business as "Wright, Robertson, & Co.," of Dunedin, aforesaid, Merchants, Plaintiffs, and John Switzer, lately of Dunedin, aforesaid, now beyond the Seas, Merchant, Defendants, and in order that the plaintiffs may proceed in the said action:

We command you that you do retain and keep all and singular lands and hereditaments, monies, and chattels, bills, bonds, and other property of whatsoever nature in the custody or under control of you or either of you at the time of the service of this writ belonging to the above-named defendant John Switzer or to or in which defendant shall at that time be legally or equitably entitled or otherwise beneficially interested and whether solely or jointly with any other person or persons and all debts of any kind then due by you to such defendant although the same or any part thereof may be payable at a future day: And we further command you that you in your own proper persons be and appear before such Judge of our said court as shall be sitting in chambers on Saturday, the fourteenth day of May instant, at ten o’clock in the forenoon, and to be examined touching the premises and to do and receive what shall then and there be considered of you in that behalf and this you shall in nowise omit.

Witness CHRISTOPHER WILLIAM RICHMOND, Esquire, Judge of our said Court at Dunedin, this ninth day of May, one thousand eight hundred and sixty-four.

THE following Despatches, with their Enclosures, from Her Majesty’s Principal Secretary of State for the Colonies, are published for general information.

WILLIAM FOX.

Downing Street,
22nd January, 1864.

I enclose for your information and for the guidance of the Immigration Officers in the Colony under your government, Copies of an Order in Council, passed on the 7th instant, for preserving order, promoting health and securing cleanliness and ventilation on board Passenger Ships proceeding from the United Kingdom.

This Order revokes the one dated 25th of February, 1856, but re-enacts its provisions with some additions. The principal additions are contained in the 20th Article, which now includes in its prohibition all immoral or indecent acts or conduct, all improper familiarities between the sexes, and all drunkenness and acts of uncleanness.

The only other material alteration is the provision in the 6th Article that the Emigrant Sweepers for the day shall pump water into tanks or cisterns for the use of the water-closet.

It will be the duty of the Immigration Officers in the Colony under your government, whenever any infraction of this Order is brought under their notice, to take the necessary steps for putting it in force by proceeding against the offenders before the proper Tribunal.

The Queen’s most Excellent Majesty in Council.

Whereas by the "Passengers Act, 1855," it is amongst other things enacted, that it shall be lawful for Her Majesty, by an Order in Council, to prescribe such rules and regulations as to Her Majesty may seem fit for preserving order, promoting health, and securing cleanliness and ventilation on board of passenger ships proceeding from the United Kingdom to any port or place in Her Majesty’s possessions abroad, and the said rules and regulations from time to time in like manner to alter, amend, and revoke, as occasion may require:

And whereas it is expedient to revoke an Order in Council made at a Court held at Buckingham Palace on
