Saturday, the fifth day of December, one thousand eight hundred and sixty-three.

WHEREAS on the twelfth day of October, one thousand eight hundred and sixty-three. Upon reading the Petition of the above-named James Lea Smither, and the affidavit of the said James Lea Smither sworn herein on the eleventh day of September, one thousand eight hundred and sixty-three, and upon hearing Mr. Barton of counsel for the said James Lea Smither: It was Ordered that within seven days from the date of the said Order, or within such extended time as this court might grant for the purpose the said Petitioner should convey, assign, and make over his real and personal effects unto Charles Hoyt, of Dunedin, coach proprietor, and John Jones, of Dunedin aforesaid, commission agent: Upon trust for the collection, and conversion into money of the said estate and effects and the distribution of the nett proceeds "pro rata" subject to the existing legal priorities (if any) among such of the creditors of the said James Lea Smither as should duly prove their respective debts by affidavits filed in the office of the registrar, at Dunedin, within the space of three calendar months from the date of the said Order. And upon, and subject to such other trusts and provisions as the court might at or before the final hearing of the said Petition direct, or approve of: And whereas by a further Order of the said court, made the twenty-third day of November, one thousand eight hundred and sixty-three, the time for making the said Assignment was enlarged to the fifth day of December, one thousand eight hundred and sixty-three: And whereas the said James Lea Smither has executed a deed of conveyance and assignment of his estate and effects in conformity with the terms of the said recited orders upon production of the said deed, and upon consideration of the matter: It is hereby Ordered that the said James Lea Smither be discharged, and released from all his debts liabilities and engagements specified in his said Petition.

In the matter of the Petition of THOMAS CARROLL, of High Street, Dunedin, livery stable-keeper, a Debtor.

Saturday, the ninth day of January, one thousand eight hundred and sixty-four.

WHEREAS on the twelfth day of December, one thousand eight hundred and sixty-three: Upon reading the Petition of the above-named debtor Thomas Carroll, and the affidavit of the said Thomas Carroll, sworn herein, on the seventeenth day of October, one thousand eight hundred and sixty-three, and annexed to the said Petition, and upon hearing Mr. Barton of counsel for the said Petitioner: It was Ordered that on the ninth day of January, one thousand eight hundred and sixty-four, the said Thomas Carroll should convey, assign and make over all his real and personal estate and effects unto Henry Driver, of Dunedin, horse and cattle salesman, and Joseph Reany, of Dunedin aforesaid, saddler: Upon trust for the collection and conversion into money of the said estate and effects, and the distribution of the nett proceeds "pro rata" subject to the existing legal priorities (if any) among such of the creditors of the said Thomas Carroll as should duly prove their respective debts within six months from the date of the said Order, and upon, and subject to such other trusts and provisions as this court might at or before the final hearing of the said Petition, direct, or approve of: And whereas the said Thomas Carroll has executed a deed of conveyance and assignment of his estate and effects in conformity with the terms of the said recited Order upon production of the said deed, and upon consideration of the matter, It is hereby Ordered that the said Thomas Carroll be discharged and released from all his debts, liabilities and engagements specified in said Petition.

NOTICE is hereby given that the above-named Charles Williams with the concurrence of the above-named George Perriman, on the 1st day of March, 1864, presented a Petition to Mr. JUSTICE RICHMOND, praying that the estate of the said Charles Williams should be sequestrated for the benefit of all his creditors and that the said Petition was accepted by His Honor who has appointed the ninth day of May next, at eight o’clock in the forenoon, at the Supreme Court House, Dunedin, for hearing the same.

NOTICE is hereby given that the above named James Laverty, now a prisoner for debt, in Her Majesty’s Gaol at Dunedin, on the twenty-fifth day of February 1864, presented a Petition to His Honor Mr. JUSTICE RICHMOND, praying for his discharge from custody, and for relief according to the provisions of the "Debtors and Creditors Act, 1862," and that the said Petition was accepted by His Honor the Judge, who has appointed Monday the ninth day of May next, 1864, at Ten o’clock in the forenoon, at the Supreme Court House, Dunedin, for the hearing of the said Petition.
