Land Reservation Proclamation




PROCLAMATION

Reserving for purposes of Sale and exempting from Mining Operations the Towns of Clyde, Cromwell, Frankton, Queenstown, and Kingston, in the Province of Otago.

By the Honorable John Hyde Harris, Superintendent of the Province of Otago.

WHEREAS by Proclamation, dated the fifteenth day of September last, published in the Government Gazette of the said Province, certain lands were constituted a Gold Field, under the name of the Dunstan Gold Field, and the limits of the same were thereby defined; and whereas the Town of Clyde, and the Town of Cromwell, hereinafter described, are within the limits of the said Dunstan Gold Field; and whereas by the said Proclamation certain other lands were also constituted a Gold Field, under the name of the Wakatipu Gold Field, and the limits of the same were also thereby defined; and whereas the Town of Frankton, the Town of Queenstown, and the Town of Kingston, hereinafter described, are within the limits of the said Wakatipu Gold Field: and whereas by Section VIII. of the "Gold Fields’ Act, 1862," it is enacted that it shall be lawful for the Governor in Council to exempt from occupation, under any Miner’s Right or Business License, any Crown Lands, or class of Crown Lands, within a Gold Field: and whereas by Section XLVIII. it is further enacted that any District proclaimed, or to be proclaimed, a Gold Field, and subject to the provisions of the said Act, shall not be subject to the provisions of the "Waste Lands Act, 1858," or the several Acts, Ordinances, Bills, and Regulations specified in the Schedule thereto: Provided always that it shall be lawful for the Governor, at any time subsequent to the Proclamation of a Gold Field, to reserve or withdraw for purposes of Sale any Waste Lands, or lands within any portion of a Gold Field, over which a Pastoral License does not exist, or has been cancelled, or suspended, and which he may deem necessary for settlement, public purposes, or roads; which land shall then be dealt with under the Waste Land Regulations of the Province in which such Gold Field shall be declared: And whereas by Section LXII. of the said "Gold Fields Act, 1862," it is further enacted that it shall be lawful for the Governor in Council, from time to time to delegate to the Superintendent of any Province, or to such other person as the Governor may deem fit, all or any of the powers vested in the Governor, or the Governor in Council, by the said Act, except the powers conferred by Sections XIX., XXXI., XXXII., XXXIII., and LXI. thereof, subject or not to any limitations or restrictions as he may think fit: And whereas, by delegation under the hand of His Excellency, Sir George Grey, Knight, Commander of the most Honorable Order of the Bath, Governor and Commander-in-Chief over Her Majesty’s Colony of New Zealand, dated at the Government House at Auckland, on the fifteenth day of September, one thousand eight hundred and sixty-three, and issued under the public seal of the said Colony, his Excellency by and with the advice and consent of his Executive Council, and in exercise of the power and authority for that purpose in him vested, did delegate, absolutely and without restriction, unto me John Hyde Harris, as Superintendent of the Province of Otago, all the powers vested by the "Gold Fields Act, 1862," in him and his Council, except the powers contained in Sections XIX., XXXI., XXXII., XXXIII., and LXI. of the said Act to have, hold, and exercise within the said Province of Otago the powers by the said Act given: And whereas no Pastoral Licenses exist over any of the lands hereinafter described, as contained and included within and occupied by each of the respectively after-mentioned Towns: and whereas I do deem the said lands necessary and required for purposes of settlement, public purposes, and roads, and that it is expedient that the said lands should be reserved and withdrawn for sale, and should be exempted from occupation, under Miner’s Rights or Business Licenses;

Now, therefore, I, John Hyde Harris, Superintendent of the Province of Otago, by virtue of the powers delegated to and vested in me in that behalf by the Governor in Council, do hereby Proclaim and Declare that I do withdraw and reserve for sale, the lands hereinafter described as contained within and occupied by the several Towns of Clyde, Cromwell, Frankton, Queenstown, and Kingston, respectively—that is to say:

TOWN OF CLYDE,

situate in the Dunstan Gold Field, containing, by admeasurement, eight hundred and six (806) acres, more or less, in the North-eastern District of the Province of Otago, on the eastern bank of the Clutha River, about one mile north of the Wai Keri Keri Stream, with roads, sections, and reserves, as pegged off, and shown on the map of the said Town; bounded towards the North-west by Crown Lands, five thousand one hundred and forty-one and four-tenths (5141.4) links; towards the North-east, by Crown Lands, twelve thousand eight hundred and forty-four and four-tenths (12840.4) links; towards the South-east, by Crown Lands, six thousand five hundred and ninety-three and seven-tenths (6593.7) links.
