Notice of Appointment of Liquidator
David Ross Petterson, forensic accountant of Levin, was appointed liquidator of SUPERIOR STORES LIMITED, pursuant to section 241(2)(c) of the Companies Act 1993, upon the order of Justice Mallon pursuant to an application made under section 174 of the Companies Act 1993.
The liquidation commenced on Thursday 2 February 2017 at 4.30pm.
Notice of No Meeting to be Called
The liquidator does not consider that a meeting of creditors should be held as:
a. the records of the company have not been maintained such that the creditors of the company may be identified;
b. the assets of the company are unknown; and
c. the director of the company has failed to respond to requests for information.
When the liquidator has more information he will advise, in writing, all identified creditors of the updated position.
Accordingly no meeting of creditors will be called in the interim unless a creditor gives notice in writing to the liquidator, within 10 working days after the publication of this notice, requiring a meeting to be called.
Notice to Creditors to Claim
Notice is also given that the liquidator fixes Friday 24 February 2017 as the day on or before which the creditors of the company are to make their claims and to establish any priority their claims may have, under section 312 of the Companies Act 1993, or to be excluded from the benefit of any distribution made before the debts are claimed or, as the case may be, from objecting to the distribution.
