Notice of Intention to Take Land for Road—282 Glenvar Road, Long Bay, Auckland

Notice is hereby given that the Auckland Council proposes to take, under the provisions of section 23 of the Public Works Act 1981:

i. the land described in the First Schedule to this notice for road;

ii. the leasehold estate (“lease”) described in the Second Schedule to this notice (on the terms and conditions described in the Fifth Schedule to this notice) for temporary occupation for road construction work;

iii. an access and maintenance easement in gross over the land described in the Third Schedule to this notice and containing the rights and powers set out in Schedule 4 to the Land Transfer Regulations 2002 and Schedule 5 to the Property Law Act 2007; and

iv. a specific design zone being a land covenant and restrictive covenant in gross over the land described in the Fourth Schedule to this notice.

The land and interests are required for the Glenvar Ridge Road Project (“project”) and, more particularly, the land and interests are required for roading purposes.

The reasons why the Auckland Council considers it reasonably necessary to take the land and interests are as follows: To provide a safe, multi-modal roading network, and for the construction of the Glenvar Ridge Road Project, which will make the movement of traffic and people along this corridor more effective for both local and through traffic by linking Glenvar Road with the development in the area. The designation for the Glenvar Ridge Road Project is approved in the district plan and includes the land for roading purposes.

The owner of the land and those persons with a registered interest in it have been served with notice of the Auckland Council’s intention to take the land and interests and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department of Courts, PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.
