Notice of Order for Suspension of Practitioner

In the matter of the New Zealand Lawyers and Conveyancers Disciplinary Tribunal:

Pursuant to section 256 of the Lawyers and Conveyancers Act 2006 ("Act"), notice is hereby given that on 1 June 2016 the New Zealand Lawyers and Conveyancers Disciplinary Tribunal ordered, pursuant to section 242(1)(e) of the Act, that

be suspended from practice as a barrister or as a solicitor, or as both, for a period of nine months from 1 June 2016.

Notice of Granting of a Scheduled International Air Service Licence

Pursuant to section 87N(4) of the Civil Aviation Act 1990, sections 41(1) and 42 of the State Sector Act 1988, and a delegation from the Secretary for Transport dated 10 September 2013, notice is given that, having received an application from Hong Kong Airlines of Hong Kong, Peter Mersi, Secretary for Transport in the Ministry of Transport, has granted the airline a Scheduled International Air Service Licence, authorising it to carry on scheduled services between Hong Kong and New Zealand, without capacity restraints.

The licence, which is for an indefinite term, took effect from 6 September 2016.

Declaration That No New Permits Are to be Issued for Commercial Operations

Pursuant to Regulation 15 of the Marine Mammals Protection Regulations 1992, I, Martin Kessick, Acting Deputy Director-General, Operations, Department of Conservation, hereby give notice that for a period of 10 years from 16 September 2016, no new permits shall be granted for commercial operations to view dolphins, whales or seals, or swim with dolphins or seals, in all those waters between Snuffle Nose (172° 49.5396E, 43° 53.3206S) and Pompey’s Pillar (173° 04.7565E, 43° 51.2091S) including Akaroa Harbour, and extending out seaward to 4 nautical miles from the coast between 172° 46.0857E, 43° 56.3792S and 173° 07.8296E, 43° 54.4656S.

This declaration does not apply to the following types of application that may be made in accordance with the provisions of the Marine Mammals Protection Regulations 1992:

  • any application to renew an existing commercial marine mammal permit to view dolphins, whales or seals, or swim with dolphins or seals, which the Director-General considers, in his or her opinion, is on the same or similar conditions, for the area specified above;

  • any application to amend an existing commercial marine mammal permit, which in the opinion of the Director-General, would have a minor effect on Hector’s dolphins or is of short duration;

  • any application to the Director-General by a permit holder to transfer the permit holder’s commercial marine mammal permit if the application does not seek an increase in, or would not result in an increase in, the level of effect on Hector’s dolphins;

  • any application for a new commercial marine mammal permit which has been accepted by the Director-General and has been advertised under Regulation 11 of the Marine Mammals Protection Regulations 1992 before the date of this declaration.
