Notification of Proposed Maritime Rules

In accordance with section 448 of the Maritime Transport Act 1994, Maritime New Zealand gives notice of the making of the following maritime rules:

Maritime Rules Parts 31, 32 and 34 SeaCert Amendment 2016

All listed rules come into force on 30 September 2016.

Rules are available for inspection free of charge, or for purchase at a cost, from Maritime New Zealand, Level 11, 1 Grey Street, Wellington, or on the Maritime New Zealand website

Notice of Exemption from Maritime Rules and Marine Protection Rules: 19.63; 20.21(b); 31.86(1); 40B.7(2); 40B.21(2)(a); 40D.27(9); 40D.37(1), Appendix 1, 1.1; 40D.37(1), Appendix 1, 1.4; 122.4(2)

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 8 July 2016 to 11 August 2016, of the following exemptions:

  • 1 from Maritime Rule 19.63 – Maritime Transport Operator – Certification and Responsibilities – Survey requirements – Completion of surveys and alternative survey arrangements

  • 1 from Maritime Rule 20.21(b) – Operating Limits – Requirement to operate within lesser of operating limits assigned to ship or operating limits that apply to Master – Master of a ship may perform his or her functions and duties under privileges associated with master’s certificate of competency set out in Part 32

  • 1 from Maritime Rule 31.86(1) – Crewing and Watchkeeping – Minimum crewing requirements for fishing vessels – Minimum required certificates and minimum number of crew

  • 1 from Maritime Rule 40B.7(2) – Design, Construction and Equipment – SOLAS ships – Subdivision and stability – Ensure ship complies with applicable subdivision and damage stability requirements of Parts B, B-1, B-2, B-3 and B-4, and applicable requirements of Part A, of Chapter II-1 of SOLAS

  • 1 from Maritime Rule 40B.21(2)(a) – Design, Construction and Equipment – SOLAS ships - Life-saving appliances and arrangements – Compliance with applicable performance standards of Chapter III of SOLAS

  • 1 from Maritime Rule 40D.27(9) – Design, Construction and Equipment – Fishing ships – Machinery – Fuel systems – Petrol tanks must be integral with the hull structure

  • 1 from Maritime Rule 40D.37(1), Appendix 1, 1.1 – Design, Construction and Equipment – Fishing ships – Life-saving appliances – Life-saving appliances are provided in accordance with the requirements of Appendix 1 – Unlimited ships – Survival craft (rescue boats)

  • 1 from Maritime Rule 40D.37(1), Appendix 1, 1.4 – Design, Construction and Equipment – Fishing ships – Inshore limit ships – Survival craft – Every ship of 12 metres or more in length must be provided with one or more liferafts, complying with Rules 42A.11 and 42A.12

  • 1 from Marine Protection Rule 122.4(2) – Marine Protection Products – Oil – Oil filtering equipment – Approval of oil filtering equipment by Director and ensure oil content when discharged not exceed 15 parts per million
