Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right to drain stormwater easement.

The applicant claims the right to drain stormwater easement is redundant by reason of the circumstances set out below.

I intend to remove the right to drain stormwater easement described below on 4 April 2016 if no objections have been received before that date.

Applicant: Lemont Holdings Limited, c/o Young Carrington & Ussher, PO Box 845, Taranaki Mail Centre, New Plymouth 4340.

Easement: A right to drain stormwater easement over parts marked "L" and "N" on DP 471905 appurtenant to Lot 2 DP 354205 specified in Easement Certificate 472322.11 – 24 July 2000 at 10.50am.

Circumstances: The dominant land has become physically separated from the servient land as a result of the subdivision of DP 354205.

The applicant claims the party wall right easement is redundant by reason of the circumstances set out below.

I intend to remove the party wall right easement on 4 April 2016 if no objections have been received before that date.

Easement: Party wall right over part Lot 5 DP 481526 marked "A" on DP 481526 comprised in Computer Freehold Register 675529 as appurtenant to part Lot 1 DP 55953 formerly Lot 4 DP 9193 comprised in Computer Freehold Register CB33F/155 and parts Lot 1 DP 50102 and Lot 2 DP 55953 formerly Lot 4 DP 9193 comprised in Computer Freehold Register CB33F/156 created by Transfer 187336 registered on 27 February 1925.

Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision DP 50102.
