Notice of Claim

This notice is pursuant to section 101(2) of the Public Trust Act 2001.

To all creditors and claimants of WAIHEKE ISLAND OF JAZZ LIMITED (a company that ceased trading on 31 March 2012):

The sum of $5,635.16 has been paid to Public Trust to hold in the name of the deregistered company.

A claim has now been lodged by the shareholders of WAIHEKE ISLAND OF JAZZ LIMITED.

Public Trust proposes paying the amount of the claim, less associated costs to WAIHEKE ISLAND OF JAZZ LIMITED, subject to no notice of an alternative claim being received on or prior to 16 July 2015.

Any persons having any interest in priority to the claimant must submit a claim to Public Trust, PO Box 13245, Tauranga 3141 (Attention: Trish Voelkerling) on or prior to the above-mentioned date.

Note: This is the first and only notice of this claim.

An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 20 July 2015, the Register will be updated to record the easement as redundant.

Easement: Right of way, electricity and telephone rights over part Lot 32 DP 393254 marked “H” on DP 393254 comprised in Computer Freehold Register 374060 and appurtenant to Lots 18, 19, 20, 22 and 26 DP 206082 comprised in Computer Freehold Registers NA134B/543, NA134B/544, NA134B/545, NA134B/546 and NA134B/550 created by Easement Certificate D527501.2 produced on 27 July 2000 at 3.37pm and entered on 9 August 2000 at 9.00am.

Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of subdivision shown on DP 393254.
