Notice of Exemption From Maritime Rules and Marine Protection Rules: 20.21; 21.13(1)(b); 31.20(1); 31.42(a); 31.42(c); 31.44; 31.82(1); 32.12(1)(b)(iii); 32.12(1)(c); 32.12(1)(d); 32.17A(c); 40A.33(2)(e); 40C.50(d); 40C.72(1); 40C.78(2)(b); 40C.80(b); 40C.51, Appendix 2.3; 40C.53, Appendix 4.1; 40D.11(1); 40D.68(1), Appendix 3.3; 43.15; 46.11(2)(a); 46.17(1)(a); 47.8(2)(a); 122.4(1) and (2)

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 2 from Maritime Rule 20.21 – Operating Limits – Requirement to operate within lesser of operating limits assigned to ship or operating limits that apply to Master

  • 10 from Maritime Rule 21.13(1)(b) – Safe Ship Management Systems – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length are not required to comply with section 1 – Entry to and conditions to be met in order to remain in Safe Ship Management System – New Zealand Safe Ship Management Certificate issued by Director

  • 2 from Maritime Rule 31.20(1) – Crewing and Watchkeeping – General crewing and other requirements – General duty related to minimum crewing – Owner and master of ship must monitor effectiveness of crew carried on an on-going basis

  • 1 from Maritime Rule 31.42(a) – Crewing and Watchkeeping – General crewing and other requirements – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Owner and master of ship must not operate ship unless minimum crew on board holding prescribed endorsements or ancillary proficiencies remain in force

  • 1 from Maritime Rule 31.42(c) – Crewing and Watchkeeping – General crewing and other requirements – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Owner and master of ship must not operate ship within coastal and offshore limits unless minimum crew on board holding certificates prescribed by rule 31.44

  • 1 from Maritime Rule 31.44 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ship operating beyond restricted limits but within coastal or offshore limits must carry specified navigational and engine room watchkeepers

  • 1 from Maritime Rule 31.82(1) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Requirement to operate under Minimum Safe Crewing Document for some ships – Owner and master of passenger and non-passenger ship must not operate ship unless minimum qualified crew on board as required by a Minimum Safe Crewing document

  • 1 from Maritime Rule 32.12(1)(b)(iii) – Ships’ Personnel – Qualifications – Bridge watchkeepers, mates and masters – New Zealand Offshore Master (NZOM) – Requirement for 18 months sea service in a deck capacity, including 12 months sea service in last 10 years

  • 1 from Maritime Rule 32.12(1)(c) – Ships’ Personnel – Qualifications – Office in charge of a navigational watch of a foreign going ship route – Completion of sea service prescribed in subrule (2)

  • 1 from Maritime Rule 32.12(1)(d) – Ships’ Personnel – Qualifications – Bridge watchkeepers, mates and masters – New Zealand Offshore Master (NZOM) – Provide evidence of attendance and completion of training programme and of having passed oral and written examinations
