Conditions

(a) The names and addresses are accessed only by the named persons and that the information is for the named person’s own use;

(b) The names and addresses are accessed only for a specified purpose;

(c) To access the Motor Vehicle Register a private investigator licence and a certificate of approval under the Private Security Personnel and Private Investigators Act 2010 must be held;

(d) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;

(e) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;

(f) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;

(g) Before 30 June 2014, the above persons must provide the Secretary for Transport with a report providing details of the purpose, the date, and the vehicle registration number of each enquiry made in relation to the Motor Vehicle Register during the term of the authorisation; and

(h) Subject to the conditions contained in this notice, the terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.

Power-assisted Cycles (Declaration Not to be Motor Vehicles) Notice 2013

Pursuant to section 168A(2) of the Land Transport Act 1998, and pursuant to an authority delegated to me by the General Manager, Access & Use, of the NZ Transport Agency, I, Ian Baggott, Manager Technical Support Certification & MVR, declare power-assisted cycles (as defined below) fitted with electric auxiliary propulsion motor(s) that have a combined maximum power output not exceeding 300W not to be motor vehicles.

The notice entitled “Power-assisted Cycles (Declaration Not to be Motor Vehicles) Notice 2011”, published in the New Zealand Gazette, 12 May 2011, No. 64, page 1494, is revoked.

Definitions

Cycle means:

(a) a vehicle that has at least two wheels and that is designed primarily to be propelled by the muscular energy of the rider; and

(b) includes a power-assisted cycle.

Power-assisted cycle means a cycle to which is attached one or more auxiliary propulsion motors that have a combined maximum power output not exceeding 300W.


Explanatory Note

This note does not form part of the notice but is intended to indicate its general effect:

(a) The definitions of cycle and power-assisted cycle are copied from the Land Transport (Road User) Rule 2004 in order to ensure consistency between the Rule and this notice.

(b) This notice has been amended to refer to electrically powered vehicles only because the usual internal combustion engines being fitted to cycles produce far more than 300W power.

(c) For the avoidance of doubt readers are advised that the District Court has held that low powered electric scooters are NOT power-assisted cycles, but are motor vehicles (of a type known as mopeds).

Notice of New and Altered Geographic Names, and Altered Crown Protected Area Names, for Ngāti Whātua o Kaipara Treaty of Waitangi Settlement 2013

Pursuant to sections 77–81 of the Ngāti Whātua o Kaipara Claims Settlement Act 2013 (“the Settlement Act 2013”), the New Zealand Geographic Board Ngā Pou Taunaha o Aotearoa (“the Board”) hereby gives notice of nine new and six altered geographic names, and one altered and two discontinued Crown Protected Area (CPA) names.

Schedule 1 below specifies the details of the new geographic names; their geographic feature types and their descriptions.

Schedule 2 below specifies the details of the altered geographic names; their geographic feature types; their descriptions; and their former names.

Schedule 3 below specifies the details of the one altered CPA name; its generic term; its description; and its former CPA name.

Schedule 4 below specifies the details of the two discontinued CPA names; their generic terms; their descriptions; and former New Zealand Gazettes.
