(b) Payless Energy Limited is close to obtaining an ISO 9001 equivalent certification;
(c) amending the exemption will assist a small new entrant to enter the market, which could lead to increased competition for the long-term benefit of consumers; and
(d) due to the small number of ICPs involved, amendment to the exemption will have little or no impact on other participants and service providers, and will not affect any other provisions of the Electricity Industry Participation Code 2010.

Electricity Industry (Exemption No. 165 (Mighty River Power Limited)) Exemption Notice 2013
Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 165 (Mighty River Power Limited)) Exemption Notice 2013.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
- Exemption—Mighty River Power Limited (MRPL) is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 (“Code”) in respect of the following installation control points (“ICPs”):

- Term—This exemption expires at the earlier of:
(a) the date on which the Electricity Industry Participation (Metering Arrangements) Code Amendment 2011 comes into force; and
(b) the date, as recorded in the registry, on which MRPL no longer has the responsibility as the trader for the ICPs listed above.
- Reasons for granting the exemption—The reasons for granting this exemption are:
(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) MRPL would incur significant expenditure in fitting meters to each ICP where the loads are predominantly street lights, bus shelters and speed cameras with low annual consumption volumes (but over the 3,000 kWh level for unmetered load);
(c) the loads at these ICPs are static, have little annual variation, and load changes can be accurately tracked;
(d) MRPL will continue to treat the loads as standard unmetered loads and record the information in the registry;
(e) the ICPs are likely to comply with the new threshold (6,000 kWh per annum) for predictable unmetered load when the new Part 10 of the Code comes into force; and
(f) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions.

Notice of the Electricity Industry Participation (Temporary Grid Reconfiguration) Code Amendment 2013

Pursuant to section 38(3)(b) of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives notice of the making of the Electricity Industry Participation (Temporary Grid Reconfiguration) Code Amendment 2013.

The amendment is made urgently under section 40 of the Act. The amendment comes into force on 15 March 2013.

The amendment enables Transpower to temporarily remove interconnection assets from service or temporarily reconfigure the grid in specified circumstances where doing so results in a net benefit, to improve the operation of the electricity system.

The Authority considers that it is desirable to make the amendment urgently because:
(a) due to ongoing dry conditions in the lower South Island, inflows into the Waiau catchment area are extremely low and there is a risk of reaching the low operating range of Lake Te Anau and Lake Manapouri. When the absolute minimum of the low operating range of those lakes is reached, the output of Manapouri hydroelectric power station is restricted to inflows only. Under a continued low inflow scenario, the absolute minimum would be reached by about 15 April 2013;
(b) a temporary grid reconfiguration could provide a significant benefit by enabling increased transmission of electricity into Southland, which is needed to meet demand.
