Fisheries Act 1996

Fisheries (Whangateau Harbour Cockle and Pipi Harvest Closure) Notice 2013 (Notice No. MPI 130)

Pursuant to section 11 of the Fisheries Act 1996, the Minister for Primary Industries gives the following notice.

Notice

  1. Title—This notice is the Fisheries (Whangateau Harbour Cockle and Pipi Harvest Closure) Notice 2013.

  2. Interpretation—In this notice, “cockle” means any shellfish of the species Austrovenus stutchburyi and “pipi” means any shellfish of the species Paphies australis.

  3. Commencement—This notice comes into force on 25 March 2013.

  4. Expiry—This notice shall expire on 26 March 2016.

  5. Whangateau Harbour closed for the taking of cockles and pipi—No person may take or possess cockle or pipi from the Whangateau Harbour from 26 March 2013 until 26 March 2016.

  6. Customary Fishing—This notice does not restrict the taking of fish, aquatic life or seaweed taken in accordance with:

    (a) Regulation 27 of the Fisheries (Amateur Fishing) Regulations 1986; or

    (b) Regulation 27A of the Fisheries (Amateur Fishing) Regulations 1986; or

    (c) The Fisheries (Kaimoana Customary Fishing) Regulations 1998.

  7. Whangateau Harbour—In this notice the Whangateau Harbour means that area of the New Zealand fisheries waters enclosed by a line that:

    (a) commences at the eastern end of the northern most groyne at Omaha sand spit (Te Taumutu Point) at 36°19.27'S and 174°46.70'E; then

    (b) proceeds across the entrance to the Whangateau Harbour to Ti Point at 36°19.17'S and 174°47.05'E; then

    (c) proceeds along the line of Mean High Water Springs in an anti-clockwise direction around the Whangateau Harbour to the point of commencement.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (South Island Customary Fishing) Notice (No. 1) 2013 (Notice No. MPI 133)

Pursuant to Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director Māori Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 1) 2013.

    (2) This notice shall come into effect on 7 March 2013.

  2. Interpretation—(1) In this notice:

    “area/rohe moana” means the area described in clause 4(1).

    (2) Terms used in this notice have the same meaning as in the Fisheries (South Island Customary Fishing) Regulations 1999.

  3. Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Kaikōura, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Sir Mark Solomon as a Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana described in clause 4(1) below for a further five-year term.

  4. Appointment of Tangata Tiaki/Kaitiaki—(1) On 3 February 2013, the Minister for Primary Industries appointed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, Sir Mark Solomon as a Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana from the Clarence River to the Hurunui River, extending seaward from each point in an easterly direction to the limit of the ‘South Island fisheries waters’, being the 200-mile limit, as well as inland to the boundaries defined for Te Rūnanga o Kaikōura in Te Rūnanga o Ngāi Tahu (Declaration of Membership) Order 2001.

    (2) The appointment described in clause 4(1) will expire on 6 March 2018.

  5. Power to authorise taking of fisheries resources for customary food-gathering—Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, for customary food-gathering.
