Third Schedule

Terms and Conditions for Right to Drain Water Easements in Gross
The easement shall have the rights and powers implied into such easements as set out in the Fourth Schedule to the Land Transfer Regulations 2002 and the Fifth Schedule of the Property Law Act 2007.

Where there is a conflict between such implied rights, the provisions of the Fourth Schedule to the Land Transfer Regulations 2002 shall prevail.

Road Realignment—State Highway 60 Ruby Bay Bypass, Tasman District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Jessica Earnshaw, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road which, pursuant to section 88(2) of the Government Roading Powers Act 1989, becomes road, limited access road and State highway and shall vest in the Crown;

(b) Pursuant to section 20, declares, pursuant to an agreement to that effect having been entered into, the land described in the Second Schedule of this notice is acquired for the functioning indirectly of a road and shall vest in the Crown;

(c) Pursuant to section 119, declares the land described in the Third Schedule to this notice to be taken for severance and, pursuant to section 120(3), amalgamated with the land in Computer Freehold Register 605936, subject to Part IVA of the Conservation Act 1987, section 11 of the Crown Minerals Act 1993 and mortgage 9406799.2, on the date of publication hereof in the New Zealand Gazette.
