Electricity Governance Regulations (Exemption No. 106 (New Zealand Aluminium Smelters Limited)) Exemption Notice Revocation Notice 2013

Pursuant to section 11(3) of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 106 (New Zealand Aluminium Smelters Limited)) Exemption Notice Revocation Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Revocation—The Electricity Governance Regulations (Exemption No. 106 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2009* ("Exemption 106") is revoked.

3. Reasons for granting the revocation—The reasons for granting this revocation are:

(a) the Electricity Authority has granted the Electricity Industry (Exemption No. 176 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2013† ("Exemption 176");

(b) Exemption 176 replicates the exemption granted under Exemption 106 but extends it to two other clauses and extends the duration to 31 December 2030;

(c) Exemption 106 is therefore no longer required;

(d) revoking Exemption 106 will result in administrative efficiency, rather than New Zealand Aluminium Smelters Limited ("NZAS") having two separate exemptions, granted under different legislation, and with different expiry dates;

(e) such efficiency will result in marginally lower costs for NZAS, which is in the long-term benefit of consumers; and

(f) the revocation will reduce administration and compliance costs, so the benefit of the revocation will outweigh any disadvantage.

Electricity Industry (Exemption No. 174 (N L & C E Wensley)) Exemption Notice 2013

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 174 (N L & C E Wensley)) Exemption Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—N L & C E Wensley ("Wensley") is exempted from compliance with the obligation in clause 15.7 of the Electricity Industry Participation Code 2010 ("Code") to provide monthly retailer electricity supplied information to the reconciliation manager for the following three installation control points ("ICPs"):

(a) 0000031475NT4F1;

(b) 0000003774NT9DB; and

(c) 0000042819NTC4A.

3. Term—This exemption expires on the date that Wensley becomes responsible for more than these three ICPs.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) granting the requested exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) without the exemption, Wensley would incur disproportionately high administration and compliance costs providing the monthly total quantity of electricity supplied for these three ICPs;

(c) the electricity supplied information required under clause 15.7 is information that is not required for reconciliation purposes; and

(d) the exemption will have little impact on other participants and service providers, and will not affect any other Code provisions.

Electricity Industry (Exemption No. 176 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2013

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 176 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—New Zealand Aluminium Smelters Limited ("NZAS") is exempted from complying with the following clauses of the Electricity Industry Participation Code 2010 ("Code"), in respect of the local network at TWI2201:

(a) clause 10.13(1);

(b) clause 11.10; and

(c) clause 15.38.

3. Term—This exemption expires at the close of 31 December 2030.
