Fisheries (South Island Customary Fishing) Notice (No. 15) 2013 (Notice No. MPI 227)
Pursuant to Regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Acting Director Māori Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 15) 2013.
(2) This notice shall come into effect on 18 September 2013.

Interpretation—(1) In this notice, “area/rohe moana” means the area from Piopiotahi to Tokatā (Milford Sound to the Nuggets). The area extends seaward to the limit of the South Island fisheries waters, being the 200-mile limit, as well as inland to boundaries defined for Te Rūnanga o Awarua and Ōraka-Aparima and the Hokonui and Waihōpai Rūnaka in Te Rūnanga o Ngāi Tahu (Declaration of Membership) Order 2001. The area includes South Island waters about and within Rakiura (Stewart Island) and other offshore islands situated within the exclusive economic zone.
(2) Terms used in this notice have the same meaning as in the Fisheries (South Island Customary Fishing) Regulations 1999.

Cancellation of appointment—On 26 August 2013, the Minister for Primary Industries cancelled, under Regulation 10(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Neil Herrick and the late Katherine Barrett-Rawiri, Robina Thomson and Bob Warren as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.

Nomination of Tangata Tiaki/Kaitiaki—Ōraka-Aparima Rūnaka, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Ronald Bull, Philip Fluerty, Lynley McKay and Dave Taylor as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana for five-year terms.

Appointment of Tangata Tiaki/Kaitiaki—(1) On 26 August 2013, the Minister for Primary Industries appointed, under Regulation 10(2) of the Fisheries (South Island Customary Fishing) Regulations 1999, Ronald Bull, Philip Fluerty, Lynley McKay and Dave Taylor as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.
(2) The appointments described in clause 5(1) will expire on 17 September 2018.

Nomination of Tangata Tiaki/Kaitiaki—Ōraka-Aparima Rūnaka, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Stewart Bull, Jane Davis, Ann Johnstone (now known as Ann Wakefield), Muriel Johnstone and Betty Rickus as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana for further five-year terms.

Appointment of Tangata Tiaki/Kaitiaki—(1) On 26 August 2013, the Minister for Primary Industries appointed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, Stewart Bull, Jane Davis, Muriel Johnstone, Betty Rickus and Ann Wakefield (née Johnstone) as Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana.
(2) The appointments described in clause 7(1) will expire on 17 September 2018.

Power to authorise the taking of fisheries resources for customary food-gathering—Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
