The land is required for the construction and operation of a road and busway from Mount Wellington Highway to the Sylvia Park retail centre.

It is necessary to take the land and all associated interests to provide for more convenient public transport, cycle and pedestrian access between Mount Wellington Highway and the Sylvia Park retail centre and it is integral to the efficient functioning of the local roading network.

The owners of the land and those persons with a registered interest in it have been served notice of the Auckland Council’s intention to take the land and have been advised of their rights to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Ministry of Justice, PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Reserves Act 1977

Revocation of the Reservation Over a Reserve Specifying the Manner of Disposal and How to Utilise Proceeds of Sale

Under the Reserves Act 1977, the Conservation Support Manager for the East Coast Bay of Plenty Conservancy of the Department of Conservation revokes the reservation as a local purpose (pedestrian access way) reserve over the land described in the Schedule and declares that the land may be disposed of by the Tauranga City Council in such a manner, at a price and on terms and conditions as the council determines, the proceeds from sale to be paid into the general funds of the council.

Authorisation of the Exchange of Reserve for Other Land

Pursuant to section 15 of the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Tasman District Council authorises the exchange of the local purpose (esplanade) reserve described in the First Schedule for the fee simple land described in the Second Schedule. The land in the First Schedule shall become fee simple land in the name of the Greenacres Golf Club Incorporated, and the land in the Second Schedule shall become local purpose (esplanade) reserve vested in the Tasman District Council.
