Notices Under the Animal Products Act 1999

Pursuant to section 164 of the Animal Products Act 1999, notice is given of the issue on 21 June 2012 of the:
(a) Animal Products (Contaminant Monitoring and Surveillance) Notice 2012; and
(b) Animal Products (Regulated Control Scheme – Hormonal Growth Promotants) Notice 2012.
Both notices come into force on 1 July 2012.

Biosecurity Act 1993
General Permission Notice Under Sections 52 and 53 of the Biosecurity Act 1993 for the Operation of Plant Nurseries That Stock Kiwifruit Plants Infected With Pseudomonas syringae pv. actinidiae
(Notice No. MPI 24)
Pseudomonas syringae pv. actinidiae (“Psa”) is an unwanted organism under the Biosecurity Act 1993 (“the Act”).
Under sections 52(d) and 53(2) of the Act, a person appointed as a chief technical officer (“CTO”), under section 101 of the Act, may give permission to persons to allow them to carry out acts that are prohibited by those sections.
Pursuant to sections 52 and 53 of the Act, I permit the owners and/or managers of plant nurseries stocking kiwifruit plants that are likely or known to be infected with or show symptoms of being infected with Psa (“affected nurseries”), and any person acting under their direction or control, (“permission holders”) to:
(a) move plant material from plants of the genus Actinidia (“kiwifruit”) onto and off the nursery;
(b) move vehicles, clothing and equipment onto and off the nursery;
(c) cause or permit kiwifruit plants or parts of plants to be in a place where kiwifruit plants or parts of plants are offered for sale or are exhibited; and
(d) sell or offer for sale kiwifruit plants or parts of plants and to carry out or act in a manner that is likely to cause the propagation, breeding, multiplication, exhibition and sale of kiwifruit plants or parts of plants.
Permission Conditions
This permission is granted subject to the following conditions:

Movement of infected or potentially infected kiwifruit plants or plant material is restricted to properties already known to be infected with Psa.

Prior to leaving a nursery or Psa infected property, vehicles, clothing and equipment must be subject to a cleaning and hygiene procedure approved by Kiwifruit Vine Health Incorporated (KVH).

Transportation of infected or potentially infected kiwifruit plants or plant material must be in secure, windproof and waterproof containers. Should any material accidentally escape from any of the containers, appropriate action will be taken to immediately retrieve it.

Symptomatic kiwifruit vines from affected nurseries must be managed to reduce the Psa inoculum loading in the air to a reasonable level, including pruning, collection, storage and/or disposal, in accordance with procedures approved by KVH.
The permission contained in this notice is given for the purposes of sections 52 and 53 of the Act only, and does not constitute an exemption from the requirements of any other relevant legislation.
This permission takes effect on the date it is published in the New Zealand Gazette and remains in force until it is revoked.
