Classification of a Reserve

Under section 16(1) of the Reserves Act 1977, and acting pursuant to a delegation from the Minister of Conservation, the New Plymouth District Council, pursuant to a resolution dated the 12th day of April 2011, hereby classifies the public cemetery reserve described in the Schedule, comprising Te Henui Cemetery, reserved and vested for cemetery reserve purposes under the Reserves and Other Lands Disposal and Public Bodies Empowering Act 1915 and held subject to the Burial and Cremation Act 1964, as a local purpose (cemetery) reserve, subject to the Reserves Act 1977.

Revocation of the Reservation Over a Reserve Specifying the Manner of Disposal and How to Utilise Proceeds of Sale

Under the Reserves Act 1977, and acting under a delegation from the Minister of Conservation, the Conservation Support Manager for the Tongariro Whanganui Taranaki Conservancy of the Department of Conservation revokes the reservation as a recreation reserve over the land described in the Schedule with effect that the land vests in the New Plymouth District Council as an estate in fee simple and may be disposed of by the council in such manner, at a price and on terms and conditions as the council determines, the proceeds from a sale to be paid into the general funds of the council.

Under the Reserves Act 1977, the Conservation Support Manager for the East Coast Bay of Plenty Conservancy of the Department of Conservation classifies the reserve described in the Schedule as a scenic reserve for the purposes specified in section 19(1)(a) of the Act and further declares that the reserve described in the Schedule form part of the Hidden Gorge Scenic Reserve.
