Civil Aviation Act 1990

Notification of Proposal to Make Ordinary Rules

In accordance with section 34(1)(a) of the Civil Aviation Act 1990, the Minister of Transport hereby gives notice of his intention to make the following ordinary Civil Aviation Rules:

  • CAR Part 139 Aerodromes – Certification and Operation
  • CAR Part 1 – Definitions and Abbreviations
  • CAR Part 121 Air Operations – Large Aeroplanes
  • CAR Part 125 Air Operations – Medium Aeroplanes
  • CAR Part 129 Foreign Air Transport Operator – Certification

contained in Notices of Proposed Rule Making (NPRM) 11-02, CAA Docket 8/CAR/3.

Civil Aviation Rule Parts 1, 121, 125 and 129 – are consequential amendments to the proposed complete review of Part 139.

The purpose of this rule-making proposal is to improve safety at all New Zealand aerodromes through the expansion of certification and operational requirements.

This proposal incorporates:

  • A complete review of Part 139; and
  • A certification framework that extends to aerodromes that support scheduled aircraft having a certified seating capacity of more than nine passengers, and general aviation aerodromes having flight movements above specific thresholds; and
  • Requirements for all aerodromes published in the Aeronautical Information Publication (AIP), including those not requiring certification, to meet minimum standards for aerodrome design, limitations, public protection, movement data reporting, and publication of aerodrome information. These requirements also extend to unpublished aerodromes if deemed necessary in the interest of safety; and
  • Provision of Air Traffic Services (ATS) consistent with CAA Policy; and
  • Additional measures for the protection of Air Traffic Services (ATS); and
  • Requirements for maintaining good runway surface friction characteristics and standardised real-time runway surface condition reporting; and
  • Introduction of a new aerodrome rescue fire fighting category and a requirement for an expanded rescue fire fighting communication and alerting system; and
  • Relocation of minimum standards contained in Advisory Circulars (ACs) into the Rule; and
  • Updated International Civil Aviation Organization (ICAO) Standards and Recommended Practices (SARPs) and international best practice.

Telecommunications Act 2001

Notification of Commencement of Competition Review of the Standard Terms Determination for Chorus’ Unbundled Copper Local Loop Backhaul and Unbundled Bitstream Access Backhaul Services

In accordance with section 30R of the Telecommunications Act 2001 (“the Act”), the Commerce Commission (“Commission”) gives public notice of its decision to commence a review of the standard terms determinations for the designated services Chorus’ unbundled copper local loop backhaul (telephone exchange to interconnect point) (UCLL Backhaul) and unbundled bitstream access backhaul (UBA Backhaul).

The purpose of this review is to determine on which parts of Chorus’ network Chorus must supply the UCLL Backhaul or UBA Backhaul service in response to an Access Seeker.

The closing date for submissions on the questions raised in the Commission’s information request is 20 April 2012.

Under section 30R(1) of the Act, the Commission may, on its own initiative, commence a review, at any time, of all or any of the terms specified in a STD.

The Commission regularly undertakes reviews of competition in the markets for UCLL Backhaul and UBA Backhaul.
