Conditions

(a) The names and addresses are accessed only by Avon Towing & Salvage Limited solely for its own use;

(b) The names and addresses are accessed only for the specified purpose;

(c) To access the Motor Vehicle Register in connection with vehicle recovery, Avon Towing & Salvage Limited must hold, and continue to hold, a vehicle recovery service licence issued pursuant to the Land Transport Rule: Operator Licensing 2007;

(d) Avon Towing & Salvage Limited must ensure that, in connection with vehicle recovery, a tow authority is completed in every case before name and address details are accessed from the Motor Vehicle Register;

(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;

(f) Access must be restricted solely to a centralised location and to members of staff for whom authorised access is essential to achieving the specified purpose;

(g) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;

(h) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;

(i) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose;

(j) Records must be kept of the purpose, occasions, and vehicle registration plate numbers whenever name and address details are accessed from the Motor Vehicle Register; and

(k) Subject to the conditions contained in this notice, the terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.

Maritime Transport Act 1994

Declaration of Major Maritime Event

Pursuant to section 200A(1) of the Maritime Transport Act 1994, and on the application of the Auckland Council, I declare the Volvo Ocean Race 2011/12 Auckland Stopover to be an event to which section 200B of the Maritime Transport Act 1994 applies for the period from 5 March 2012 to 18 March 2012 inclusive.

Designated Area

The area in respect of which this declaration applies comprises the following areas:

General Designated Area

The area designated Waitemata Harbour, bounded in the west by an approximate north/south boundary between Chelsea Wharf and Watchman Island and bounded in the east by an approximate north/south boundary between North Head and Bastion Point, and includes all navigable waters within this area.

The area designated the Rangitoto Channel and the area directly to the east of the North Shore, from Bastion Point in the south, to an approximate east/west boundary in the north between Toroa Point and the point 3.5 nautical miles north-east of Torbay.

This area is bounded in the west by the natural shoreline, and bounded in the east by an approximate north/south boundary between Bean Rock and the point 3.5 nautical miles north-east of Torbay, and includes all navigable waters within this area.

The exact positions of the boundary points for the area requested are set out below.

Maps depicting the designated area, and certain areas to which special restrictions apply, will be published in the New Zealand Herald and on the Auckland Council website www.aucklandcouncil.govt.nz just prior to the event commencing.
