MASSEY UNIVERSITY PRIMARY ACCOUNTING RESEARCH TRUST FUND

Notice of Application to Amend Trust Deed

The MASSEY UNIVERSITY PRIMARY ACCOUNTING RESEARCH TRUST FUND, otherwise known as the Delahunty Trust (“the Trust”) has, on 14 February 2012, applied to the High Court at Palmerston North, under Part 3 of the Charitable Trusts Act 1957, for approval of a scheme.

The scheme proposes to amend the Trust in the following ways:

  1. The current object of the Trust be deleted and replaced with the following object:

    “To establish a perpetual charitable trust fund to provide education and research into accounting and other business activities for land based primary industry. Other business includes (but is not limited to) development, sustainability, finance, marketing, business structures and logistics.”

  2. The description of the Trustees of the Trust be deleted and replaced with the following:

    “The nominee of: a) the Head of the School of Accountancy, Massey University; and b) the Pro Vice-Chancellor of the College of Sciences, Massey University; and c) the Chairman of the Manawatu Branch of the Institute of Chartered Accountants of New Zealand; or if any of the above positions no longer exist then the nominee of the person holding the relevant equivalent position of a), b) or c) above.”

The application will be heard by the High Court at Palmerston North on 29 March 2012 at 10.00am.

Any person wishing to oppose the scheme must, by seven clear days before 29 March 2012, give written notice of his or her intention to do so to:

(a) The Registrar of the High Court at Palmerston North; and
(b) The trustees of the Trust, care of their solicitors Cooper Rapley Lawyers (details below); and
(c) The Attorney-General at Crown Law Office, PO Box 2858, Wellington 6140 (Attention: Peter Gunn).

The applicant is the MASSEY UNIVERSITY PRIMARY ACCOUNTING RESEARCH TRUST FUND, whose address for service is at the offices of Cooper Rapley Lawyers, 240 Broadway Avenue, Palmerston North. Postal Address: PO Box 1945, Palmerston North 4440.

Notice of Application to Amend a Trust Deed

The PELORUS TRUST (“the Trust”) has, on 14 February 2012, applied to the High Court at Wellington, pursuant to Part 3 of the Charitable Trusts Act 1957, for approval of a scheme.

The scheme proposes to amend the charitable purpose of the Trust in its trust deed to confirm that the primary object of the Trust is to provide educational benefits to and/or improve the health of people in the community via the promotion of amateur games or sport.

The application will be heard by the High Court at Wellington on 19 March 2012 at 10.00am.

Any person wishing to oppose the scheme must, by seven clear days before 19 March 2012, give written notice of his/her intention to do so to:

(a) The Registrar of the High Court at Wellington;
(b) The trustees of the Trust, care of their solicitors Chapman Tripp (details below); and
(c) The Attorney-General at Crown Law Office, PO Box 2858, Wellington 6140 (Attention: Peter Gunn).
