Electricity Industry (Exemption No. 148 (Network Waitaki Limited)) Exemption Notice 2012
Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 148 (Network Waitaki Limited)) Exemption Notice 2012.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

Exemption—Network Waitaki Limited ("Waitaki") is exempted from compliance with clause 2 of Schedule 11.1 of the Electricity Industry Participation Code 2010 ("Code") in respect of the following installation control points ("ICPs"):

Term—This exemption expires at the earlier of:
(a) the close of 30 November 2013; and
(b) the date on which clause 2 of Schedule 11.1 of the Code is amended to no longer require a location address to be included in the registry for the ICPs listed above.
- Reasons for granting the exemption—The reasons for granting this exemption are:
(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) if the exemption is not granted, and a Code amendment is not made, Waitaki would need to create and manage hundreds of new ICP identifiers for each individual street light and payphone in order to comply with clause 2 of Schedule 11.1;
(c) Waitaki would incur significant compliance costs associated with creating and maintaining the new ICP identifiers for these low-volume unmetered loads if the exemption was not granted;
(d) location addresses for individual loads such as street lights and payphones are generally available within a retailer’s distributed unmetered load database enabling each load item to be readily located; and
(e) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

Exemption—Contact Energy Limited ("Contact") is exempted from compliance with clause 11(3) of Schedule 15.3 of the Electricity Industry Participation Code 2010 ("Code") in respect of the following installation control points ("ICPs"):

Term—This exemption expires on the date on which Contact no longer has the responsibility in the registry as the trader for the ICPs listed above.

Reasons for granting the exemption—The reasons for granting this exemption are:
(a) Contact would incur significant compliance costs in setting up the distributed unmetered load ("DUML") databases for these low consumption ICPs;
(b) the cost of maintaining the databases and undertaking annual audits of them would be disproportionate to the size of the load;
(c) the load at these ICPs is static, will have little annual variation, and changes can be accurately tracked;
(d) Contact has stated it will continue to treat the loads as standard unmetered loads and record the information in the registry;
(e) creating new ICP identifiers for each of the points of connection at each of the 11 ICPs would avoid the need to establish a DUML database at each ICP because each ICP could then be treated as a standard unmetered load rather than aggregated as a distributed unmetered load. However, this would impose additional fixed charges on consumers for no extra benefit;
(f) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and
(g) granting the exemption meets the requirements of section 11(2) of the Act.
