Hazardous Substances and New Organisms Act 1996

Dental Products Group Standard (Amendment) Notice 2011

Pursuant to section 96B(3) of the Hazardous Substances and New Organisms Act 1996 (“the Act”), the Environmental Risk Management Authority New Zealand (“ERMA New Zealand”) gives notice that two group standards are amended.

Notice

  1. Title—(1) This notice is the Dental Products Group Standard (Amendment) Notice 2011 and is part of the principal notice.

(2) In this notice, “principal notice” means the Hazardous Substances (Group Standards) Notice 2006 (Supplement to the New Zealand Gazette, 30 June 2006, No. 74, page 1889).

  1. Commencement—The amendments referred to in this notice come into force 24 months after the date of their notification in the New Zealand Gazette.

  2. Amendments to Group Standards—(1) This notice amends the Dental Products (Oxidising, [5.1.1]) Group Standard 2006 and the Dental Products (Subsidiary Hazard) Group Standard 2006 referred to in Part 12 of the principal notice at page 2077.

(2) This notice amends the Group Standards in respect of tooth-whitening products and oral hygiene products containing or releasing hydrogen peroxide by:

(a) requiring the provision of precautionary statements on labels and accompanying information;

(b) placing restrictions on the sale of tooth-whiteners containing hydrogen peroxide; and

(c) placing restrictions on the commercial application procedures of tooth-whiteners containing hydrogen peroxide.

(3) The changes to the Dental Products (Oxidising, [5.1.1]) Group Standard 2006 include a change to the scope of the group standard (to add skin corrosive, HSNO class 8.2 when it results from hydrogen peroxide).

  1. Availability—The full original group standards and amended group standards as well as Schedules and any information incorporated by reference may be:

(a) inspected free of charge during normal business hours at the ERMA New Zealand office; or

(b) purchased from ERMA New Zealand; or

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Risk Management Authority New Zealand (“ERMA New Zealand”) advises that it approved on 23 June 2011,

the code of practice “Periodic Testing of Compressed Gas Cylinders to AS 2337.1: 2004 and AS 2337.3: 2006”.

This code has been developed by ERMA New Zealand, pursuant to Regulation 52(3)(d) of the Hazardous Substances (Compressed Gases) Regulations 2004.

The code sets out cylinder testing requirements equivalent to the requirements of the standard referred to in Regulation 52(3)(b), AS 2337.1:1999.

Pursuant to section 80 of the HSNO Act, this code may be viewed or downloaded from the ERMA New Zealand website www.ermanz.govt.nz or a copy obtained from the Wellington office of ERMA New Zealand, Level 1, BP House, 20 Customhouse Quay, Wellington.

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Risk Management Authority New Zealand (“ERMA New Zealand”) advises that it approved on 23 June 2011,

the code of practice “The Control and Safe Use of Fumigants, Version 2.0, Parts 1 and 2”.

This code has been developed by the Pest Management Association of New Zealand Incorporated.

Parts 1 and 2 set out a means of compliance with the requirements of the Hazardous Substances (Fumigants) Transfer Notice 2004 (as amended) and incorporate the changes to the controls on methyl bromide that came into effect in May 2011 (HRC08002).
