Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 ("the Act"), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:

  • who are currently registered in respect of a motor vehicle(s); and
  • who have not instructed the Registrar of Motor Vehicles to withhold their details.
Person Purpose Term
Waterstone Recovery Limited To obtain name and address details in respect of vehicles recovered during a liquidation/receivership. 1 May 2011 to 30 April 2016 inclusive

Conditions

(a) The names and addresses are accessed only by Waterstone Recovery Limited on its own behalf and solely for its own use;

(b) The names and addresses are accessed only for the specified purpose;

(c) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;

(d) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;

(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all new staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;

(f) Access must be restricted solely to members of staff for whom authorised access is essential for the specified purpose;

(g) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose; and

(h) Waterstone Recovery Limited must comply with the Motochek Terms and Conditions, available at https://motochek.landtransport.govt.nz/mcpro/default.asp?category=mcpro&service=Terms

Officer of the Government of Ross Dependency Appointed

Background:

A. An Order in Council dated 30 July 1923* ("the order") made under the British Settlements Act 1887 (UK) appoints the Governor-General of New Zealand to be the Governor of the Ross Dependency ("the Governor") and vests in the Governor certain powers:

B. The order empowers the Governor to make rules and regulations for the peace, order, and good government of the Dependency;

C. Regulations made by the Governor on 14 November 1923† provide that all persons appointed by the Governor may be empowered to do such things as may be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty’s rights and sovereignty over and in respect of the Dependency;

D. It is now expedient that Troy Kevin Beaumont be appointed an officer of the Government of the Dependency;
