Notice of Approval Given Pursuant to Section 160(3) of the Crown Entities Act 2004

Pursuant to section 160(3) of the Crown Entities Act 2004, I, Jeremy Salmond, Acting Treasury Solicitor, hereby give notice that on or around 8 March 2011, the Honourable Simon William English, Minister of Finance and the Honourable Steven Leonard Joyce, Minister of Transport, gave approval under section 160(1)(b) of the Crown Entities Act 2004, in relation to section 162 of that Act, for the New Zealand Transport Agency to borrow $137 million from the Crown to fund the TEL roading project, on such terms and conditions as the Minister of Finance considers appropriate, to be captured in the loan agreement at the time the loan is required.

Notification of Emergency Directive

Pursuant to section 27G(4) of the Civil Aviation Act 1990, I, Steve Douglas, Director of Civil Aviation, hereby make the following Emergency Directive.

Background

As a result of the Christchurch City earthquake of 22 February 2011, it is necessary to provide relief, without compromising civil aviation safety, to persons applying for medical certification under the Civil Aviation Rules who are unable to meet the requirements of Civil Aviation (Timetable for Routine Examinations) General Directions Notice 2009*. The Director considers it appropriate to issue the following Emergency Directive, under section 27G(4) of the Civil Aviation Act 1990, to provide appropriate relief from the requirements regarding the routine examinations required by the General Direction and specified in the Schedule to the General Directions.

Emergency Directive

Purpose

This Emergency Directive provides relief from the requirements for the timing of examinations that an applicant for medical certificate is routinely required to have as part of the medical examination referred to in section 27D(1) of the Act. The relief provided is directed towards applicants who have been affected by the Christchurch City earthquake.

Application of Civil Aviation (Timetable for Routine Examinations) General Directions Notice 2009

The timing of applicable routine examinations set out in the Schedule to the Civil Aviation (Timetable for Routine Examinations) General Directions Notice 2009 shall not apply to applicants for medical certificates, whose current address for service or previous address for service at 22 February 2011 required under section 8 of the Civil Aviation Act 1990, is within the Canterbury region provided that:

  1. The applicant notifies the Director of Civil Aviation in writing that he/she seeks relief from Civil Aviation (Timetable for Routine Examinations) General Directions Notice 2009 in accordance with this Emergency Directive; and
  2. The Director of Civil Aviation is satisfied that action taken including the consideration of medical information regarding the applicant and the imposition of conditions on the medical certificate or restrictions on the validity period of the medical certificate relating to the applicant, is effective in minimising any additional risk to civil aviation safety.
