Fisheries (South Island Customary Fishing) Regulations 1999

Notification of Wairewa/Lake Forsyth Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki (No. F543)

Pursuant to Regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Chief Executive of the Ministry of Fisheries gives the following notice:

Pursuant to Regulation 20, by a notice published in the New Zealand Gazette, 10 June 2010, No. 64, page 1849, the Minister of Fisheries and Aquaculture declared a mātaitai reserve over all fisheries waters of Lake Forsyth and outlet that flows into the sea and the Takiritawai River that flows into the northern end of Lake Forsyth, excluding any other river or stream or tributary that flows into or from any of these fisheries waters.

A mātaitai reserve is an identified traditional fishing ground in South Island fisheries waters established for the purpose of customary food gathering.

The Minister of Fisheries and Aquaculture, in an instrument dated on the 31st day of May 2010, appointed Charlie Zimmerman, Iaean Cranwell, John Boyles, Rei Simon, Robin Wybrow and Theo Bunker as Tangata Tiaki/Kaitiaki for the mātaitai reserve.

The appointment is for a term of five years.

The mātaitai reserve and appointment of Tangata Tiaki/Kaitiaki take effect from 8 July 2010.

Commercial fishing within the mātaitai reserve is prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.

The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mātaitai reserve.

No fishing for customary food gathering purposes may take place in the mātaitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.
