Fisheries (South Island Customary Fishing) Notice (No. 5) 2010 (No. F535)

Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Deputy Chief Executive Fisheries Management at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 5) 2010.

(2) This notice shall come into effect on 28 May 2010.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

(b) “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.

(c) “area/rohe moana” means the area around Ruapuke Island bounded by a line starting at point (168°40′E, 46°42.4′S); then in a southerly direction to a point (168°40′E, 46°50′S); then in a westerly direction to a point (168°22.6′E, 46°50′S); then in a northerly direction to a point (168°22.6′E, 46°42.4′S); returning to the first-mentioned point.

  1. Nomination of Tangata Tiaki/Kaitiaki—The Topi and Whaitiri Whānau, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu through Te Rūnanga o Awarua), have nominated Ricky James Topi (Topi Whānau) and Christine Mary Young (Whaitiri Whānau) as replacement Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.

  2. Appointment of Tangata Tiaki/Kaitiaki—On 26 April 2010, the Minister of Fisheries and Aquaculture appointed, under Regulation 10(2) of the Fisheries (South Island Customary Fishing) Regulations 1999, Ricky James Topi and Christine Mary Young as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana for five-year terms. The appointments will expire on 27 May 2015.

  3. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

Health and Disability Services (Safety) Act 2001

Designation of Auditing Agency

Pursuant to section 32 of the Health and Disability Services (Safety) Act 2001 (“the Act”), I, Mark Richards, Acting Deputy Director-General, Regulation & Governance Directorate, Ministry of Health (“the Ministry”), under delegation from the Director-General of Health, designate Global-Mark Pty Limited (the “Designated Auditing Agency” (DAA)) to audit the provision or likely future provision of the following kind of health care service:

  • New Zealand Fertility Services.

This designation is subject to the following conditions:

  1. The DAA must comply with the relevant requirements of the DAA Handbook issued by the Ministry and updated from time to time.

  2. Promptly after giving a certified provider or prospective provider an audit report, the DAA must:

    • complete the Ministry of Health Audit Report Tool and provide an electronic copy to the Ministry; and
    • provide a summary of the audit report to the Ministry (refer to condition 9).
  3. The DAA must provide any information about the auditing of health care services pursuant to the Act if requested in writing by the Ministry.

  4. During the term of the DAA’s designation, the DAA will allow the Ministry to audit or commission the undertaking of audits or reviews of the DAA. This could also include attending audits being undertaken by the DAA. The Ministry may or may not notify the DAA of any audit or review.

  5. The DAA must immediately notify the Ministry in writing of any significant change to the DAA, including but not restricted to:

    • any change in ownership and/or control of the legal entity;
    • any change in management personnel;
    • any change in pricing;
    • any change to the Auditor Register (refer to condition 8); and
    • any change in the status of any third party accreditation the DAA may hold including evidence of such accreditation and copies of any Third Party Accreditation Audit Reports or notifications in respect of their accreditation.
  6. The DAA must conduct as a minimum at least one annual:

    • internal audit that focuses on the DAA’s auditing activities undertaken pursuant to the Act, together
