Notice of Intention to Take Land for Roading Purposes—24 Totara Avenue, New Lynn, Waitakere City

Notice is hereby given, in accordance with section 23(1)(b) of the Public Works Act 1981, that the Waitakere City Council ("the Council") proposes to take all of the land situated at 24 Totara Avenue, New Lynn, Waitakere City, and more particularly described in the Schedule hereto ("the land").

The land is required for roading purposes.

The reasons why the Council considers it is reasonably necessary to take this interest in the land described in the Schedule are:

(a) to cater for the development and regeneration of New Lynn town centre;

(b) to meet the agreed objectives embodied in the Council’s District Plan Change 17, that will enable New Lynn to meet the needs of a modern town centre;

(c) to achieve the objectives of the New Lynn Transit Oriented Development project (this project is included in the New Zealand Transport Agency’s current funding programme) and assist in the regeneration of the New Lynn town centre.

The owner of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take the land and of their right to object.

Any other person having a right to object to the proposed taking of the said land may forward a written objection to the Registrar, Environment Court, Department of Courts, Level 8, 3 Kingston Street, Auckland 1010, or to PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days of the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held. The objector will have a right to appear and be heard personally unless the objector otherwise requires. Each objector will be informed of the time and place of the hearing.

The land to be taken is situated at 24 Totara Avenue, New Lynn, Waitakere City, and is legally described as 460 square metres, being part Allotment 257 Parish of Waikomiti and being all of the land comprised and described in Computer Freehold Register NA599/151.

Notice of Intention to Take Land for Road—Tauranga

Notice is hereby given that the Tauranga City Council ("the Council"), under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto ("the land").

The land described in the Schedule to this notice is required for road.

It is intended to use the land as part of the road system in accordance with the designation in the district plan.

The intended taking is considered reasonably necessary to cater for increasing traffic volumes and to provide access onto the proposed Sandhurst Interchange (State Highway 2) from the local road network.

The owners of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take their land, and their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days of the date of publication of this notice.
