Electricity Governance Regulations 2003

Notice of Amendment to the Electricity Governance Regulations (Exemption No. 103 (New Zealand Steel Limited)) Exemption Notice 2009

Pursuant to Regulation 196 of the Electricity Governance Regulations 2003, the Electricity Commission (“Commission”) gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 103 (New Zealand Steel Limited)) Exemption Amendment Notice 2010.

(2) In this notice, the Electricity Governance Regulations (Exemption No. 103 (New Zealand Steel Limited)) Exemption Notice 2009¹ is called the “principal notice”.

(3) This notice comes into force on 31 March 2010.

  1. Amendment to principal notice—(1) The principal notice provides an exemption from the requirement to comply with Rules 6.1, 6.4, and 6.5 of Technical Code B of Schedule C3 of Part C of the Electricity Governance Rules 2003 (“Rules”).

(2) The principal notice is amended by omitting the date on which the exemption is stated to expire (31 March 2010) and substituting 30 September 2012.

  1. Reasons for amendment—The reasons for this amendment are as follows:

(a) Having consulted on proposed options to clarify the test in Rule 6.6 of Technical Code B of Schedule C3 of Part C of the Rules and related arrangements, the Commission has decided not to progress the proposed options until a wider review of automatic under-frequency load shedding requirements has been completed by the System Operator; and

(b) expiry of the exemptions prior to the test in Rule 6.6 being clarified would result in a short-term reduction in the supply of interruptible load in the North Island which may have adverse impacts on the energy and reserves markets.
