Fisheries (Kaimoana Customary Fishing) Notice (No. 15) 2010 (No. F573)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Fisheries Manager Customary at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 15) 2010.

(2) This notice shall come into effect on 17 December 2010.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Tangata Kaitiaki” are local dialect words that have the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(c) “Tangata Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.

(d) “area/rohe moana” means the area described by a line commencing at Waipohutukawa (at 37°43.34'S and 174°49.30'E); then proceeding due east to the boundary of the Waikato Settlement; then proceeding along the Waikato Settlement boundary generally south to a point due east of Matawha Point; then proceeding due west to Matawha Point (at 37°55.20'S and 174°46.50'E); then proceeding due west to the outer limit of the New Zealand Exclusive Economic Zone; then proceeding generally north following the outer limit of the New Zealand Exclusive Economic Zone to a point due west of Waipohutukawa then due east to Waipohutukawa being the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

  1. Nomination of Tangata Kaitiaki—Waingaro Marae, acting for Ngāti Tamainupo, has nominated Basil Tutemamao Huirama Osborne, Heemi Rupapere, Beau Fontaine Tengu and Geoffrey Tengu as Tangata Kaitiaki for managing customary food-gathering in the area/rohe moana.

  2. Appointment of Tangata Kaitiaki—On 27 November 2010, the Minister of Fisheries and Aquaculture confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Basil Tutemamao Huirama Osborne, Heemi Rupapere, Beau Fontaine Tengu and Geoffrey Tengu as Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Confirmation of tangata whenua—Ngāti Tamainupo, as represented in respect to these appointments by Waingaro Marae, is confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki relates.

  4. Power to authorise the taking of fisheries resources for customary food-gathering—Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (Declaration and Notification of Kaihoka and Anatori Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (No. F566)

Pursuant to Regulations 20 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries and Aquaculture and the Chief Executive of the Ministry of Fisheries give the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Declaration and Notification of Kaihoka and Anatori Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010.

  2. Commencement—This notice shall come into effect on the 28th day after the date of its notification in the New Zealand Gazette.

  3. Interpretation—In this notice:

(a) “Mātaitai reserve” means the identified traditional fishing ground described in clause 4 of this notice.

(b) “Tangata Tiaki/Kaitiaki” means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mātaitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.

  1. Declaration of a mātaitai reserve—The Minister of Fisheries and Aquaculture declares a mātaitai reserve over all fisheries waters within the following two areas on the upper West Coast of the South Island:

(a) Kaihoka: That area of New Zealand fisheries waters enclosed by a line that:

(i) commences at a point on the mean high water mark (MHWM) on the southern bank of the river mouth within Nguroa Bay at 40°31.49'S and 172°37.42'E; then

(ii) proceeds in a straight line in a north-westerly direction to a point 1km offshore at 40°31.01'S and 172°36.78'E; then

(iii) proceeds in a generally south-westerly direction along a line every point of which is 1km from the MHWM to a point 1km offshore west of Kaihoka Point at 40°32.72'S and 172°34.18'E; then

(iv) proceeds in a straight line in a south-easterly direction to a point on the MHWM at Kaihoka Point at 40°32.97'S and 172°34.86'E; and then
