aluminium smelting has the meaning given to it in the Climate Change (Eligible Industrial Activities) Regulations 2010.

electricity contracts means electricity related contracts in force on the date of this notice (including the 1963, 1981 and 1991 electricity contracts).

NZAS means the company registered as New Zealand Aluminium Smelters Limited.

3. Electricity Contract Related Information Required to be Provided

(1) NZAS must provide the Ministry for the Environment, within 30 working days of the date of this notice, with the information specified in paragraphs 3(3)(a) to 3(3)(d) of this notice.

(2) NZAS must provide the information specified in paragraphs 3(3)(a) to 3(3)(d) in respect of the activity of aluminium smelting and for the period 1 April 2009 to 31 December 2012. NZAS must provide actual values for historic time periods where such information is known. For time periods in the future, or where such actual information is not known, NZAS must provide its best estimate of the most likely values as at the date of this notice.

(3) NZAS must provide:

(a) the total amount of electricity consumed (in GWh) by NZAS each month under each of NZAS’s electricity contracts;

(b) the total amount of electricity consumed (in GWh) by NZAS each month that was purchased on the electricity spot market (ie in excess of NZAS’s electricity contracts);

(c) the transmission escalator values used in each of NZAS’s electricity contracts; and

(d) the New Zealand generation weighted average spot price (in $/MWh) used in the energy escalator calculation in each of NZAS’s electricity contracts.

(4) NZAS may provide any additional information that it believes will assist the Minister in making a determination.

Fisheries (Conversion Factors) Amendment Notice 2010 (No. F571)

Pursuant to section 188 of the Fisheries Act 1996, the Fisheries Manager Deepwater, Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988), gives the following notice.

Notice

  1. Title—(1) This notice is the Fisheries (Conversion Factors) Amendment Notice 2010 and is part of the principal notice.

(2) In this notice, “principal notice” means the Fisheries (Conversion Factors) Notice 2005 (No. F350)*.

  1. Commencement—This notice comes into effect on the day after the date of its notification in the New Zealand Gazette.

  2. Part 2 of Schedule 2—Part 2 of Schedule 2 of the principal notice is amended by inserting the following after item 31:

“32. Patagonian toothfish—
The conversion factor for dressed Patagonian toothfish (Dissostichus eleginoides) is 1.60.”

Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Declaration and Notification of Marokopa Mātaitai Reserve and Appointment of Tangata Kaitiaki/Tiaki) Notice 2010 (No. F567)

Pursuant to Regulations 23 and 25 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries and Aquaculture and the Chief Executive of the Ministry of Fisheries hereby give the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Declaration and Notification of Marokopa Mātaitai Reserve and Appointment of Tangata Kaitiaki/Tiaki) Notice 2010.

  2. Commencement—This notice shall come into effect on the 28th day after the date of its notification in the New Zealand Gazette.

  3. Interpretation—In this notice:

(a) “Mātaitai reserve” means the identified traditional fishing ground described in clause 4 of this notice.

(b) “Tangata Kaitiaki/Tiaki” means any person or persons appointed as Tangata Kaitiaki/Tiaki for the mātaitai reserve under Regulation 24 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

  1. Declaration of a mātaitai reserve—The Minister of Fisheries and Aquaculture declares a mātaitai reserve over all fisheries waters enclosed by a line:

(i) commencing at a point on the mean high water mark (MHWM) at Tirua Point (at 38°23.20'S and 174°38.10'E); then

(ii) proceeding in a generally northerly direction along the MHWM to a point at Harihari Beach (at 38°13.10'S and 174°42.90'E); then

(iii) proceeding due west to a point 3km offshore (at 38°13.10'S and 174°40.71'E); then

(iv) proceeding in a generally southerly direction along in a line every point of which is 3km from the MHWM to a point 3km offshore due west of the point of commencement (at 38°23.20'S and 174°35.91'E); and then

(v) proceeding due east for 3km to the point of commencement.

  1. Appointment of Tangata Kaitiaki/Tiaki—The chief executive names Alan Willison and Hemi Kete as Tangata Kaitiaki/Tiaki for the mātaitai reserve.

  2. Prohibition on commercial fishing—Commercial fishing within the mātaitai reserve is prohibited under Regulation 27 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

  3. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Kaitiaki/Tiaki may authorise any individual to take fish, aquatic life or seaweed from within the whole or any part of the mātaitai reserve. No fishing for customary food gathering purposes.
