General Permission Notice Under Sections 52 and 53 of the Biosecurity Act 1993 For Operation of Kiwifruit Orchards That Have Been Confirmed as Positive For Pseudomonas syringae pv. actinidiae
Notice No. 1700
Pseudomonas syringae pv. actinidiae (“Psa”) is an unwanted organism under the Biosecurity Act 1993 (“the Act”).
Under sections 52(d) and 53(2) of the Act, a person appointed as a chief technical officer (“CTO”), under section 101 of the Act, may give permission to persons to allow them to carry out acts that are prohibited by those sections.
Pursuant to section 52 of the Act, I permit the owners, managers, or occupiers of kiwifruit orchards that have been confirmed as positive for Psa (“affected orchards”), and any person acting under their direction or control (“permission holders”), to:
(a) move plant material from plants of the species Actinidia (“kiwifruit”) onto and off the orchard; and
(b) move vehicles, clothing and equipment onto and off the orchard.
Pursuant to section 53 of the Act, I permit the affected orchards and permission holders:
(a) to cause or permit kiwifruit plants or parts of plants to be in a place where kiwifruit plants or parts of plants are offered for sale or are exhibited; and
(b) to carry out the propagation, breeding, multiplication, exhibition and sale of kiwifruit plants or parts of plants.
This permission is granted subject to the following conditions:

Vehicles, clothing and equipment leaving an affected orchard must be subject to a cleaning and hygiene procedure approved by an industry management agency for Psa that is recognised by the CTO.

Transportation of symptomatic kiwifruit material from affected orchards must be in secure, windproof and waterproof containers and any material that escapes from the container must be retrieved immediately.

Symptomatic kiwifruit vines from affected orchards must be managed, including pruning, collection, storage and/or disposal, in accordance with procedures approved by an industry management agency for Psa that is recognised by the CTO.
The permission contained in this notice is given for the purposes of sections 52 and 53 of the Act only, and does not constitute an exemption from the requirements of any other relevant legislation.
This permission takes effect on the date it is published in the New Zealand Gazette and remains in force until it is revoked.

Pursuant to section 11G of the Food Act 1981, notice is given of the issue on 29 November 2010 of the Food (Tutin in Honey) Standard 2010 which comes into force on 1 January 2011.
