Notification of Initiation of the Process for a New Determination for the Designated Multinetwork Services of ‘Local Telephone Number Portability’ and ‘Cellular Telephone Number Portability’ Under the Telecommunications Act 2001

Pursuant to section 35 of the Telecommunications Act 2001 ("the Act"), the Commerce Commission ("the Commission") gives public notice of its decision to initiate a process for a determination for the designated multinetwork services of "local telephone number portability" and "cellular telephone number portability" after 19 December 2010.

Currently, Decision 554 ("the Determination") dated 31 August 2005* (which has been clarified on a number of occasions) governs the local and cellular telephone number portability services and is due to expire on 19 December 2010.

Under section 31AA of the Act, the Commission may, on its own initiative, at any time, initiate the process for a determination of:

(a) the functions that must be performed by a system for delivering the designated multinetwork service and the standard to which those functions must be performed; and

(b) the formula for how the cost of delivering the service must be apportioned between the access seeker and all access providers of the service.

The Commission considers that there are reasonable grounds to initiate the process for review of the Determination under section 31AA(2) of subpart 3 of Part 2 of the Act because the Determination is due to expire.

On 7 October 2010, the Commission received submissions from affected parties in relation to the initiation of the Commission’s inquiry, and all parties agreed that an investigation was required.

Hazardous Substances and New Organisms Act 1996

Notice of Intention to Apply for Approval of Code of Practice

Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority (ERMA) gives notice that the Environmental Risk Management Agency intends to apply for approval of the Code of Practice for the Design and Installation of Below Ground Petroleum Stationary Container Systems, and the Code of Practice for the Operation of Below Ground Petroleum Stationary Container Systems.

These codes have been developed by the Environmental Risk Management Agency and set out a means of compliance with the requirements of clauses 33(a), 73(3)(a)(iii), 73(3)(b)(iii) and 86 of the Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer Notice 2004 (as amended), for stationary container systems that are installed below ground.

The codes are the result of further work following the first round of submissions on Below Ground Petroleum Stationary Container Systems at the beginning of 2010. The original document has now been split into two separate documents.
