Biosecurity (Gypsy Moth Levy) Order 2004

The levy is imposed on all shipping containers imported and used vehicles imported into New Zealand.

Under Regulation 11(2) of the Biosecurity (Gypsy Moth Levy) Order 2004, the Director-General hereby notifies the rate of levy for the 2009–2010 levy year.

This rate is the same as the rate for the 2008–2009 levy year.

The biosecurity gypsy moth levy for the levy year commencing 1 July 2009 and ending 30 June 2010 has been set at:

$0.65 (inclusive of GST) per shipping container or used vehicle.

The levy is calculated on the basis of dividing:

(a) the estimated annual cost of a surveillance programme for gypsy moth; by

(b) the estimated number of shipping containers and used vehicles to be imported annually into New Zealand.

The levy is imposed on all importation of goods (on which the total duty payable is $50.00 or more) where an importer has:

(a) made an import entry under section 39(1) of the Customs and Excise Act 1996; or

(b) lodged a document that the chief executive has required to be lodged under:

(i) Regulation 25(i)(iii) of the Customs and Excise Regulations 1996; or

(ii) Regulation 26(2) of the Customs and Excise Regulations 1996.

However, no levy is imposed on goods that are specified in Regulation 24A(4) of the Customs and Excise Regulations 1996.

Under Regulation 11(2) of the Biosecurity (Risk Screening Levy) Order 2006, the Director-General hereby notifies the rate of levy for the 2009–2010 levy year.

This rate is the same as the rate for the 2008–2009 levy year.

The biosecurity risk screening levy for the levy year commencing 1 July 2009 and ending 30 June 2010 has been set at $4.00 (inclusive of GST) per leviable importation.

The levy is calculated on the basis of dividing:

(a) the estimated annual costs incurred by the Ministry of Agriculture and Forestry (“the Ministry”); by

(b) the estimated total number of annual leviable importations that:

(i) are required to be entered under section 39 of the Customs and Excise Act 1996; or

(ii) are deemed to have been entered under Regulation 23 of the Customs and Excise Regulations 1996.

The “annual costs incurred by the Ministry” means:

(a) the costs of electronic import documentation screening, including related information technology development and maintenance costs;

(b) the costs of biosecurity risk assessment of imported goods;

(c) the costs of clearing goods not requiring further action by the Ministry;

(d) the costs incurred by the Director-General in administering the levy; and

(e) the costs incurred by the chief executive in collecting the levy.

Biosecurity (Shipping Container Levy) Order 2006

The levy is imposed on all shipping containers imported into and landed in New Zealand.

Under Regulation 11(2) of the Biosecurity (Shipping Container Levy) Order 2006, the Director-General hereby notifies the rate of levy for the 2009–2010 levy year.

This rate is the same as the rate for the 2008–2009 levy year.

The biosecurity shipping container levy for the levy year commencing 1 July 2009 and ending 30 June 2010 has been set at:

$20.00 (inclusive of GST) per shipping container that contains goods; and

$10.00 (inclusive of GST) per empty shipping container.

The levy is calculated on the basis of dividing:

(a) the estimated annual costs incurred by the Ministry of Agriculture and Forestry (“the Ministry”); by

(b) the estimated number of shipping containers that are imported into and landed annually in New Zealand.

The “annual costs incurred by the Ministry” means the costs incurred in implementing and administering import health standards, to the extent that the standards apply to shipping containers.
