Telecommunications Act 2001

Notification of Release of Final Requirements for the Accounting Separation of Telecom

Pursuant to section 69ZE of the Telecommunications Act 2001 ("the Act"), the Commerce Commission ("Commission") gives public notice that it has issued requirements for the accounting separation of Telecom under Part 2B of the Act.

These requirements apply for the Telecom financial years ending June 2009 and June 2010, and are made pursuant to sections 69ZB and 69ZD of the Act.

Under section 69ZB of the Act, the Commission must require Telecom to prepare and disclose information about the operation and behaviour of all or any of its network, wholesale, or retail business activities as if these activities were operated as independent or unrelated companies.

The Commission may also require Telecom to prepare and disclose information about separate business activities or services within the network, wholesale, or retail categories.

Notification of Clarification of Standard Terms Determination for Co-location on Cellular Mobile Transmission Sites Under the Telecommunications Act 2001

On 11 December 2008, the Commerce Commission ("Commission") issued a standard terms determination, under section 30M of the Telecommunications Act 2001 ("the Act"), in respect of the specified service co-location on cellular mobile transmission sites ("Decision 661").

On 30 March 2009, the Commission clarified, under section 58(1) of the Act, Decision 661.

Pursuant to section 58(2) of the Act, the Commission gives public notice that it has clarified, under section 58(1) of the Act, Decision 661.

Electricity Act 1992

Notice of Recommendation and Assessment Concerning the Electricity Governance Rules 2003 — Rule Amendment Proposal No. 140, 2008

  1. This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 ("Rules"), Rule Amendment Proposal No. 140, 2008, is issued by the Electricity Commission ("Commission") pursuant to section 172E(2)(c) of the Electricity Act 1992 ("Act").

  2. The Act provides that, no later than 10 working days after making a recommendation to the Minister of Energy and Resources ("Minister") concerning the Rules, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.

Recommended Amendments to the Rules

  1. On 25 March 2009, the Commission recommended that Part A be amended.

  2. The recommended amendments to the Rules were to provide a process by which a participant ("participant A"), with the agreement of another participant ("participant B"), and with the approval of the Commission, can take on all the rights and obligations of participant B as a purchaser or a payer under Parts C, G and H of the Rules (which relate to the electricity wholesale market).
