Notice of Entry into Possession of Mortgaged Property

Pursuant to Section 156 of the Property Law Act 2007

Notice is given as follows:

  1. On 23 March 2009, Cavell Leitch Pringle & Boyle Solicitors Nominee Company Limited, of Christchurch, as mortgagee under mortgage instrument 7435804.1, became mortgagee in possession of the property owned by Park Terrace Apartments Limited, of Christchurch, by taking physical possession of the land.

  2. The description of the property is Parkbridge 1, Parkbridge Apartments, 138–142 Park Terrace, Christchurch, and more specifically being the land contained in Unit R1 and Accessory Unit R1A, R1B DP 377151 contained in certificate of title 310024 (Canterbury Land Registration District).

  3. The address of the mortgagee is care of its registered office at Level 15, Clarendon Tower, corner of Oxford Terrace and Worcester Street, Christchurch.

Fair Trading Act 1986

Unsafe Goods (Lead in Children’s Toys) Indefinite Prohibition Notice 2009

This notice is made in accordance with section 31(3) of the Fair Trading Act 1986.

Notice

  1. Title—
    (1) This notice may be cited as the Unsafe Goods (Lead in Children’s Toys) Notice 2009.
    (2) This notice has effect from 26 March 2009.

  2. Certain children’s toys declared to be unsafe goods—
    Children’s toys which contain lead in their accessible parts at a migration level greater than 90mg/kg of toy material are declared to be unsafe goods and are prohibited from supply indefinitely.

  3. For the purposes of this notice:
    migration level means the value calculated after testing in accordance with the procedures and result interpretation provisions of the Australian/New Zealand Standard AS/NZS ISO 8124.3:2003 entitled “Safety of toys, Part 3: Migration of certain elements”.

Explanatory Note

This note is not part of the notice but is intended to indicate its general effect.

This notice declares children’s toys which contain lead in their accessible parts at a migration level greater than 90mg/kg of toy material to be unsafe goods and prohibits the supply of the goods indefinitely under section 31 of the Fair Trading Act 1986 (“the Act”).

The Unsafe Goods (Children’s Toys) Notice 2007, published in the New Zealand Gazette, 20 September 2007, No. 102, page 2758, declared these goods to be unsafe under section 31 of the Act. By virtue of section 31(2) of the Act, that notice expired on 19 March 2009.

Section 31(3) of the Fair Trading Act 1986 authorises the Minister of Consumer Affairs, if 18 months has elapsed since the goods were declared to be unsafe goods and if no product safety standard has been prescribed in respect of the goods under section 29 of that Act, to prohibit the supply of the goods indefinitely or for a specified period.

It is an offence under the Fair Trading Act 1986 to supply, or offer to supply, or advertise to supply, goods which are declared to be unsafe goods. Section 33 of the Fair Trading Act 1986 prohibits the importation of such goods into New Zealand.

Reassessment of Anti-dumping Duty: Hog Bristle Paintbrushes From China (Amendment No. 4)

Pursuant to section 14(6) of the Dumping and Countervailing Duties Act 1988 (“the Act”), the Minister of Commerce, having carried out a reassessment of the anti-dumping duty applying to imports into New Zealand of hog bristle paintbrushes from China and having determined a new rate of anti-dumping duty applicable to those goods, gives the following notice.

Notice

  1. Title and commencement—
    (1) This notice may be cited as the “Reassessment of Anti-dumping Duty: Hog Bristle Paintbrushes From China (Amendment No. 4)”.
    (2) This notice replaces and supersedes all previous notices in relation to the subject goods described below in the First Schedule.
    (3) Pursuant to section 17 of the Act, the reassessed anti-dumping duty, set out in the Second Schedule to this notice, shall apply to imports of the goods specified in the First Schedule with effect from the day after the date of this notice.
