Statement of Indemnity Given Under the Public Finance Act 1989

Pursuant to section 65ZD(3) of the Public Finance Act 1989, the Minister of Finance makes the following statement:

“On 1 November 2009, I, The Honourable Simon William English, Minister of Finance, on behalf of the Crown, gave an indemnity to the Federal Ministry of Defence of the Federal Republic of Germany as contained in the Federal Republic of Germany contract with the New Zealand Defence Force for the provision of RADAR transmitters. The indemnity relates to any claim brought against the Federal Republic of Germany by third parties arising from operating the radars on board RNZAF aircraft but also any third party liability.”
