Reclassification of Local Purpose Reserve

Section 24(1)(b) of the Reserves Act 1977 allows the Queenstown Lakes District Council (“the council”) to change the classification of a reserve.

Under the provisions of the Reserves Act 1977, the council passed a resolution at its meeting of 25 August 2006 to change the purpose from recreation reserve to local purpose (access) reserve in respect of the land described in the Schedule hereto.

Otago Land District—Queenstown Lakes District

All that piece of land, being 0.0947 hectares, and described as proposed Lot 1 DP 412692, held in certificate of title 447191 (Otago District).

Classification of a Reserve and Vesting—Queenstown Lakes District Council

Under the Reserves Act 1977, the Conservator for the Otago Conservancy of the Department of Conservation classifies the reserve described in the Schedule as a recreation reserve, and vests the reserve in the Queenstown Lakes District Council in trust for that purpose and further declares that the reserve is:

(a) subject to an easement for right of way access between Her Majesty The Queen and Signature Investments Limited dated 31 August 2001 for a term of perpetuity; and

(b) subject to an easement for a cableway between Her Majesty The Queen and National Institute of Water and Atmospheric Research dated 21 October 2002 for a term of 30 years; and

(c) subject to an easement to convey water and electricity between Her Majesty The Queen and Michael Spencer Mee dated 1 October 2003 for a term of 30 years.

Te Roroa Claims Settlement Act 2008

Notification That Part Waipoua Forest has Been Declared Te Tarehu and Agreed Protection Principles

Pursuant to section 58(1)(a) of the Te Roroa Claims Settlement Act 2008, the Minister of Conservation hereby notifies that the area described in the Schedule hereto has been declared to be Te Tarehu by section 50 of the Act.

Te Tarehu means the site declared as Te Tarehu by section 50 of the Act.

The provisions of the Act which relate to Te Tarehu are sections 49 to 67 inclusive.

Pursuant to section 51 of the Act, the Crown acknowledges the statement by Te Roroa of Te Roroa values in relation to Te Tarehu.

Te Roroa values means the statement by Te Roroa of the cultural, spiritual, historical, and traditional association of Te Roroa with Te Tarehu, the text of which is set out in paragraph 3 of Part 2 of Schedule 1 of the Deed of Settlement.

Pursuant to section 58(1)(b) of the Act, the Minister of Conservation hereby notifies that the following specific protection principles, which are set out in paragraph 4 of Part 2 of Schedule 1 of the Deed of Settlement, have been agreed by the trustees of the Manawhenua Trust and the Crown, and are directed at the Minister of Conservation avoiding harm to, or the diminishing of, the Te Roroa values related to Te Tarehu:

  1. Protection of wāhi tapu, indigenous flora and fauna and the wider environment within Waipoua Forest;
  2. Recognition of the mana, kaitiakitanga and tikanga of Te Roroa within Waipoua Forest;
  3. Respect for Te Roroa tikanga within Waipoua Forest;
  4. Encouragement of respect for the association of Te Roroa with Waipoua Forest;
  5. Accurate portrayal of the association of Te Roroa with Waipoua Forest;
  6. Recognition of the relationship of Te Roroa with wāhi tapu, and wāhi taonga.
