Designation of Fiordland as a Customs Place
I, Martyn John Dunne, acting pursuant to section 9(1) of the Customs and Excise Act 1996, hereby designate as a Customs Port, the following:
The Customs place shall be known as Fiordland and covers those areas referred to as the Internal Waters of Fiordland identified in the maps attached to the Deed of Agreement between Environment Southland as Regional Council for the Southland Region and the New Zealand Cruise Ship Industry (Cruise New Zealand Incorporated), including the adjoining sea passageway but not including Stewart Island. Within this area, and for the purposes of Customs processing, is an area generally known as Milford Sound, which comprises all land, sea and estuary to a distance of 100 metres above high water mark that is enclosed by a line drawn between Saint Anne Point and Yates Point.
I further impose the restriction under section 9(1) that the arrival and departure of craft at and from the Fiordland Customs place is restricted to cruise vessels approved under the Deed of Agreement signed between Environment Southland as Regional Council for the Southland Region and the New Zealand Cruise Ship Industry (Cruise New Zealand Incorporated); and such arrivals and departures are subject to the following further conditions:
- Adequate prior notice will be provided to Customs detailing the itinerary for the arrival and departure of all cruise vessels scheduled for the cruise season including details of expected passenger movements; and
- any changes to the itinerary will be reported immediately to Customs; and
- subject to prior approval from Customs, the embarkation and disembarkation of all persons and goods is restricted to the Milford Sound area within the Customs place; and
- the interchange of passengers and crew is not permitted within the Fiordland Customs place; and
- the number of overlanding passengers is restricted to not more than 100 passengers to or from any vessel; and
- adequate facilities as agreed are made available for all processing requirements of Customs; and
- the only goods permitted to be loaded or unloaded are the accompanied hand-carried personal baggage of passengers and crew disembarking from the craft, and subject to condition 5 above; and
- all other requirements of Customs must be met; and
- Customs reserves the right to suspend, restrict or cancel any approvals for craft (which are signatories to the Deed of Agreement) to arrive at or depart from Fiordland if any of the above conditions are not adhered to.

Termination of Countervailing Duties on Canned Peaches From the European Union
Pursuant to section 14(7) of the Dumping and Countervailing Duties Act 1988 (“the Act”), I hereby terminate the countervailing duties imposed on the subject goods described in the Schedule to this notice, with effect from 3 July 2009, because a review under section 14(8) of the Act has determined that the goods are not currently subsidised and that there is not likely to be a recurrence of subsidisation in the foreseeable future.
