Neil Stephen Gilbert
Peter Thomas Smith
to be officers of the Government of the Dependency while they act as Senior New Zealand Representatives at Scott Base during the period beginning with this appointment and ending with the close of 28 February 2009:
I confer on Edward Richard Townsend Butler, Neil Stephen Gilbert and Peter Thomas Smith, while they hold office as officers of the Government of the Dependency, all the powers exercisable in New Zealand by a Justice of the Peace:
Edward Richard Townsend Butler, Neil Stephen Gilbert and Peter Thomas Smith are to exercise their functions at such places within the Dependency as may be directed by an officer of the Government of the Dependency who has the general executive and administrative authority in preserving Her Majesty’s rights and sovereignty and the laws in force in the Dependency.
Given under the hand of His Excellency the Governor-General as the Governor of the Ross Dependency and issued this 20th day of December 2008.

Electricity Act 1992
Notice of Making of Electricity Governance Amendment Rules (No. 71) 2009 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992 ("Act"), I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Act.

The empowering provision for the Electricity Governance Regulations in relation to which the amendments to the Rules are made is section 172D(1)(1)(c) of the Act.

The existing Rule 3 of Schedule G6 of Part G of the Rules is amended. The amendments are to allow for the system operator’s scheduling, pricing and dispatch software that will be upgraded as part of the market systems project to be compliant with the Rules regarding the forming of constraints.

The amendments are made in reliance on section 172F(3) of the Act.

Pursuant to section 172Z(4) of the Act, the reason for my decision to amend the Rules is to ensure that the Rules do not inadvertently form a barrier to the provision of improved functionality being delivered through the system operator’s market systems project.

These Rules come into force on 30 March 2009.

Electricity Governance Regulations 2003
Electricity Governance Regulations (Exemption No. 99 (Orion New Zealand Limited)) Exemption Notice 2009
Pursuant to Regulation 194(2) of the Electricity Governance Regulations 2003, the Electricity Commission ("Commission") gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 99 (Orion New Zealand Limited)) Exemption Notice 2009.
(2) This notice comes into force on the date on which it is notified in the New Zealand Gazette.
- Exemption—Orion New Zealand Limited ("Orion") is exempted from compliance, on the existing interconnection point between the Orion local network (APS0111) and the WestPower local network (OTI0111), with the following:
(a) Rule 3.7 of Part D of the Electricity Governance Rules 2003 ("Rules");
(b) Rules 4.3.2 and 19 of Part J of the Rules; and
(c) All other obligations in respect of distributors’ network supply points within the Rules.
- Terms and conditions—This exemption is granted on the following conditions:
(a) Orion must notify the Commission in writing, within 20 business days, if the purpose of the existing interconnection point changes, or the frequency or volume of usage significantly increases while the exemption is in force; and
(b) It will expire on 4 February 2014.
- Reasons for granting the exemption—The reasons for granting this exemption are:
(a) Without an exemption, Orion:
(i) would incur significant unreasonable expenditure and complexity in fitting metering and communication equipment to its network for low consumption volumes;
(ii) would incur unreasonable expenditure in becoming a certified reconciliation participant;
(iii) would incur unreasonable expenditure by submitting submission information for each reconciliation period;
(iv) may need to re-assess the viability of having the interconnection point as a back up;
(b) The interconnection point is rarely used;
(c) Although the granting of the exemption will financially impact the customer on OTI0111, this customer endorsed the application for an exemption; and
(d) There will be little or no impact on other participants and service providers and it will not affect any other rules, as the transfer of volumes between the Orion and WestPower networks will balance out.
