Land Transfer Act / Joint Family Homes Act Notices

Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right to construct and maintain a water race. The applicant claims the right to construct and maintain a water race is determined by reason of the circumstances set out below.

I intend to remove the right to construct and maintain a water race on 5 March 2009 if no objections have been received before that date.

Charitable Trusts Act Notices

Presbyterian Support Central (as trustee of the Ann Sinclair Charitable Trust)

Notice of Application for Approval of a Scheme

Part 3 of the Charitable Trusts Act 1957

Take notice that on Thursday, 22 January 2009, an application for orders approving a scheme prepared under section 34 of the Charitable Trusts Act 1957 in relation to the Ann Sinclair Charitable Trust (“the trust”) was filed in the High Court at Wellington.

The application is to be heard before the High Court at Wellington on Tuesday, 24 March 2009 at 10.00am.

Any person desiring to oppose the scheme must, not less than seven clear days before the hearing date, give written notice of their intention to do so to:

(a) the Registrar of the High Court at Wellington;
(b) the trustee; and
(c) the Attorney-General.

The trust’s charitable purposes include:

(a) the provision of financial assistance to boys for education in farming; and
(b) the funding of farm training institutions willing to enrol boys who would qualify for financial assistance from the trust.

The scheme proposes to amend the charitable purposes of the trust and/or extend the powers of the trustee or vary the mode of administering the trust so that every reference to “boys” is amended to read “boys and girls”.

The intended consequence of this amendment is to enable the trust’s funds to be used to provide financial assistance to both male and female applicants.

At present, the trust is only empowered to assist with the education and training of males.
