Public Works Act 1981

Notice of Intention to Take Land for Road and for the Functioning Indirectly of a Road—Te Rapa, Hamilton, South Auckland Land District

Notice is hereby given that the Crown, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto (“the land”).

The land described in the Schedules to this notice is required for construction of the Te Rapa Bypass at State Highway 1, Hamilton.

The land described in the First Schedule is required for road.

The land described in the Second Schedule is required for the functioning indirectly of a road (segregation strip).

The project is required to cater for increasing traffic volumes and to improve the safety and efficiency of State Highway 1 and the local road network.

The owner of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take their land, and their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, PO Box 7147, Auckland, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Road Stopped and Amalgamated—Beachwood Drive, Hatfields Beach, Rodney District

Pursuant to sections 116 and 117 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares the portion of road adjoining or passing through the land described in the Schedule to this notice to be stopped, vested in Cabra Developments Limited and, pursuant to section 120(3):

(i) The land firstly described in the Schedule hereto to this notice be amalgamated with the land in Computer Freehold Register 389523, subject to mortgage D533377.5; and

(ii) the land secondly described in the Schedule hereto to this notice be amalgamated with the land in Computer Freehold Register 389524, subject to mortgage D533377.5 on the date of publication of this notice in the New Zealand Gazette.

Road Realignment—Lichfield Road, Putaruru, South Waikato District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road and to vest in the South Waikato District Council.

(b) Pursuant to sections 116 and 117, declares the portion of road described in the Second Schedule to this notice to be stopped and amalgamated with the land in the Computer Freehold Register SA723/233, subject to mortgage B363080.

(c) Pursuant to sections 116 and 117, declares the portion of road described in the Third Schedule to this notice to be stopped and amalgamated with the land in the Computer Freehold Register SA32C/642, subject to mortgage 7055435.2.
