regulations setting reasonable terms and conditions for
access to, and use of, gas processing facilities.
The Rules:
(a) require the owners of gas processing facilities to
disclose to Gas Industry Company Limited
information about their facilities including technical
capabilities and availability of spare capacity;
(b) set out obligations with respect to public disclosure
of that information by Gas Industry Company
Limited;
(c) require the owners of gas processing facilities to
disclose to Gas Industry Company Limited the
number of bona fide third party approaches
regarding access; and
(d) oblige Gas Industry Company Limited to report to
the Minister of Energy on the need for further
regulation of access to gas processing facilities after
a period of five years.
4. Copies of the Rules are available:
(a) for inspection, free of charge:
(i) at the head office of the Ministry of Economic
Development, 33 Bowen Street, Wellington,
and at the head office of Gas Industry Company
Limited, Level 9, State Insurance Tower,
1 Willis Street, Wellington (during normal
office hours); and

Notice of Making of Gas (Downstream
Reconciliation) Rules 2008
- Pursuant to section 43R of the Gas Act 1992
(“Act”), I notify the making of the Gas (Downstream
Reconciliation) Rules 2008 (“Rules”) under section 43Q of
the Act.

- The empowering provision for the gas governance
regulation in relation to which the Rules are made is section
43F(2)(a). - The purpose of the Rules is to establish a set of uniform
processes that will enable the fair, efficient, and reliable
allocation and reconciliation of downstream gas quantities.
The Rules provide for:
(a) the appointment of an allocation agent; and
(b) processes for the:
(i) provision of gas injection and consumption
information; and
(ii) allocation by the allocation agent of daily gas
quantities for each calendar month to retailers
at gas gates; and
(iii) reconciliation of downstream gas quantities;
and
(c) mandatory information disclosure and reporting by
the allocation agent, allocation participants and the
industry body; and
(d) ancillary matters related to the process of allocation
and reconciliation such as funding by industry
participants and audits. - Copies of the Rules are available:

Pursuant to sections 47A and 134AA of the Radiocommunications Act 1989, and acting under delegated authority from the chief
executive, I give the following notice.
Notice
- Title, commencement and purpose—(1) This notice is the Radiocommunications Regulations (Aggregation of Current
and Successive Management Rights – Form 3T) Notice 2008.
(2) This notice comes into force on 1 June 2008.
(3) This notice prescribes the form required for a request for aggregation of current and successive management rights pursuant
to section 47A of the Radiocommunications Act 1989. - Form for the aggregation of management rights—The form for a request for the aggregation of current and successive
management rights for presentation to the Registrar of Radio Frequencies shall be Form 3T as prescribed in the Schedule to
this notice.
