Instrument Amending Ministerial Welfare Programmes 2008
Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development and Employment makes the following instrument.

Instrument

Title—This instrument is the Instrument Amending Ministerial Welfare Programmes 2008.

Commencement—This instrument comes into effect on the day after the date on which it is made.

Welfare programmes amended—The welfare programmes set out in the Schedule are amended in the manner set out in that Schedule.

Amending previous instrument—The Schedule of the Instrument Amending Ministerial Directions and Welfare Programmes (No. 3) 2007 (given on the 25th day of June 2007 and published in the New Zealand Gazette, 5 July 2007, No. 77, page 2005) is amended by omitting:
“Course Participation Allowance”
and substituting
“Course Participation Assistance Programme”.
Schedule
Clause 3
Welfare programmes amended
Away From Home Allowance Programme (as established and approved the 19th day of January 1998 and published in the New Zealand Gazette, 29 January 1998, No. 14, page 349).
Clause 5.1.3(ii)
Omit
“or 10(1)(g)”
and substitute
“to 10(1)(h)”.
Home Help Programme (as established and approved on the 6th day of May 2004 and published in the New Zealand Gazette, 13 May 2004, No. 52, page 1290).
Clause 4(1)
Add to paragraph (m) of the definition of cash assets “:”, and add the following paragraphs:
“(n) for the period of 12 months after it is made, any compensation or ex gratia payment made by or on behalf of the Crown on or after 26 October 2007 to a person because that person was a former patient of the Lake Alice Psychiatric Hospital:
(o) any item of the kind referred to in Regulation 5 of the Social Security (Income and Cash Assets Exemptions: Superannuation Schemes) Regulations 2008 (SR 2008/68)”.
Clause 7(1)(a)(ii)
Omit
“or paragraph (m)”
and substitute
“to paragraph (n) or an item specified in paragraph (o)”.
Explanatory Note
This note is not part of the instrument but is intended to explain its general effect.
This instrument amending the Away from Home Allowance Programme and the Home Help Programme comes into effect on the day after the date on which it is made.
This instrument has the effect of excluding certain payments from a person’s cash assets, which are considered in determining his or her eligibility for the payments under the welfare programmes specified in this instrument. The exclusions are for: ex gratia payments made by or on behalf of the Crown to a person who was a former patient of the Lake Alice Psychiatric Hospital and is limited to 12 months from the date of any such payment made on or after 26 October 2007 in both welfare programmes; and the net value of a person’s member’s interest, on or after 1 May 2008, in a specified non-KiwiSaver scheme in the Home Help Programme. A drafting error in a previous instrument is also corrected.

Appointments to the Government Superannuation Fund Authority
Pursuant to section 28 of the Crown Entities Act 2004, I have appointed
Tim McGuiness
as chair of the Government Superannuation Fund Authority for a term of three years from 1 June 2008 to 31 May 2011;
and
Ralph Stockdill
as a member of the Government Superannuation Fund Authority for a further term of 18 months from 1 May 2008;
and
Helen Bowie
as a member of the Government Superannuation Fund Authority for a further term of 18 months from 1 June 2008.
