Electricity Governance Regulations (Exemption No. 77 (Nelson Electricity Limited))

Exemption Notice 2008

Pursuant to Regulation 194(2) of the Electricity Governance Regulations 2003, the Electricity Commission ("Commission") gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 77 (Nelson Electricity Limited)) Exemption Notice 2008.

(2) This notice comes into force on 1 May 2008.

2. Exemption—Nelson Electricity Limited ("Nelson") is exempted from compliance with Rule 3.7 of Part D of the Electricity Governance Rules 2003.

3. Terms and conditions—This exemption is granted on the following conditions:

(a) It shall only apply to Nelson on the embedded network HVN0331 NELS;

(b) it shall be subject to the condition that Nelson, as the embedded network owner, is responsible for ensuring that submission information is calculated by using a Commission approved methodology and is submitted to the reconciliation manager by a certified reconciliation participant in accordance with the Rules; and

(c) it shall expire on 30 April 2013.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) Without an exemption, Nelson will incur significant expenditure and complexity in the fitting of metering and communication equipment to its network for relatively low consumption volumes; and

(b) there will be little or no impact on other participants and service providers and the exemption will not affect any other Rules.

Amendment to Transit New Zealand Bylaw 2005/7* Maximum Speeds of Vehicles on State Highways

Pursuant to section 61(3) of the Transit New Zealand Act 1989 and clause 2.6 of the Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001), Transit New Zealand hereby amends the following bylaw.

Amendments

1. These amendments shall come into force 28 days after publication in the New Zealand Gazette.

2. The Transit New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2005/7* is hereby amended by:

(a) Replacing line 173 in Schedule 3 to read:

"Transit NZ Region: 3
SH No.: 23
Locality: Hamilton
From (RP): 0/0.00 To (RP):** 0/0.77

Distance from nearest Road/Feature:
SH1 to 40m west of Campbell Street.

Speed Restriction (km/h): 50

(b) Adding line 173(a) in Schedule 3 to read:

Speed Restriction (km/h): 40 and 50 (variable speed limit in school zone, during school hours between 8.25am to 9.00am and 2.50pm to 3.15pm).
