5. Urgency—(1) This exemption is granted under urgency
in reliance on Regulation 194(4).
(2) This exemption expires at the close of 31 July 2008,
being the earliest date that will enable the Commission to
have regard to the views of participants.
(3) Pursuant to Regulation 194(5)(c), the Commission will
publicise the exemption on the Commission’s website and
will have regard to any views that participants make known
to it by 5.00pm on Friday, 9 May 2008.

Land Transport Act 1998

Land Transport Rules

In accordance with section 161(2) of the Land Transport Act
1998, Land Transport New Zealand, on behalf of the Minister
of Transport, gives notice of the Minister’s intention to
make two Land Transport Rules and advises that draft Land
Transport Rule: Traction Engines [2008] and Land Transport
Rule: Vehicle Equipment (Immobilisers) Amendment [2008],
are available for public comment.

Land Transport Rule: Traction Engines [2008]
(Rule 63001)

This proposed Rule is intended to ensure the safe operation
of traction engines in public places by specifying
the qualifications for users of traction engines and the
requirements for vehicle certification.

Land Transport Rule: Vehicle Equipment (Immobilisers)
Amendment [2008] (Rule 32017/3)

This proposed Rule will amend Land Transport Rule:
Vehicle Equipment 2004.

It would require that a new or used light passenger vehicle
that is less than eight years old, and that enters New Zealand
from the date the Rule comes into force, be fitted with an
immobiliser in order to be certified for use on road.

This proposal is aimed at reducing opportunistic vehicle
theft.

proposed changes, can be obtained by calling the Land

0800 699 000 or by visiting the Land Transport New Zealand

www.landtransport.govt.nz/consultation

The consultation material is also available for viewing at
Land Transport New Zealand’s regional offices.

Groups and individuals who have registered their interest
have been advised of the availability of the draft Rules.

Submissions on draft Land Transport Rule: Traction Engines
[2008] and draft Land Transport Rule: Vehicle Equipment
(Immobilisers) Amendment [2008] close on 23 May 2008.

Education Act 1989

Amendment to the Constitution of Christchurch
Polytechnic Institute of Technology Council 2008

Pursuant to section 170 of the Education Act 1989, the
Minister for Tertiary Education gives the following notice.

Notice

  1. This notice may be cited as the Amendment to the
    Constitution of Christchurch Polytechnic Institute of
    Technology Council 2008 and will come into force on the
    date of its publication in the New Zealand Gazette.

  2. There shall be a council to be known as the CPIT
    Council (Te Kaunihera o Te Wānanga o Ōtautahi) which
    shall govern the Christchurch Polytechnic Institute of
    Technology (“CPIT”).

  3. The CPIT Council shall be constituted as follows:

(a) Four members appointed by the Minister for Tertiary
Education.

(b) The Chief Executive Officer of CPIT.

(c) One permanent member of the academic staff of
CPIT elected by the permanent members of that staff.

(d) One permanent member of the general staff of CPIT
elected by the permanent members of that staff.

(e) One member who is or has been a student of CPIT
who shall represent the students of CPIT and who
shall be appointed in accordance with the constitution
of the Christchurch Polytechnic Students Association.

(f) One member appointed by the CPIT Council after
consultation with the Canterbury Employers Chamber
of Commerce.

(g) One member appointed by the CPIT Council after
consultation with the New Zealand Council of Trade
Unions.

(h) One member nominated by Te Rūnanga a Ngāi Tahu
after consultation with their community.

(i) One member nominated by Te Puni Kōkiri or other
relevant Crown agency after consultation with their
community.

(j) One member nominated by the Ministry of Pacific
Island Affairs or other relevant Crown agency after
consultation with the Pacific Island communities.

(k) One member nominated by the Office of Disability
Issues or other relevant Crown agency after
consultation with their community.

(l) One member nominated by the Office of Ethnic
Affairs or other relevant Crown agency after
consultation with the Asian communities.

(m) Up to three members co-opted by the CPIT Council
after consultation with community and industry
groups to ensure that the overall membership of
the CPIT Council reflects the social communities
(ethnic and socio-economic diversity and the gender
make-up of the New Zealand population) and
employing sectors relevant to CPIT and includes
members with the range of competencies required
for the good governance of the institute.

  1. In the event the CPIT Council and a nominating
    organisation are unable to agree on a person for appointment
    after a consultation period not exceeding six months, then
    the relevant nominating organisation’s nominees shall be
    accepted by the CPIT Council.
