Land for Motorway and Reserve (Heath Reserve)—State Highway 1 and Exmouth Road, North Shore City

Pursuant to the Public Works Act 1981, and to a delegation
from the Minister for Land Information, R. J. Sutherland,
Land Information New Zealand:

(a) Pursuant to section 114, declares the land described
in the First Schedule to this notice to be road which,
pursuant to section 88(2) of the Transit New Zealand Act
1989, becomes road, limited access road and State highway
and shall vest in the Crown on the date of publication of this
notice in the New Zealand Gazette.

(b) Pursuant to section 116(1), declares the portion
of road described in the Second Schedule to this notice
to be stopped and further declares, pursuant to section
117(7), shall be added to the adjoining recreation reserve
(“Heath Reserve”, Gazette Notice B050761.1) subject
to section 11 of the Crown Minerals Act 1991 and Part IVA
of the Conservation Act 1987, and that for the purposes of
section 25(1) of the Reserves Act 1977, title to the land
described in the Second Schedule will be deemed not to
have derived from the Crown.
