(c) "Tangata Kaitiaki" means the person or persons
appointed under Regulation 9 or 10 of the Fisheries
(Kaimoana Customary Fishing) Regulations 1998
for the management of customary food-gathering
within the area/rohe moana.
(d) "area/rohe moana" means all that area of water
enclosed by a line commencing at the mean
high-water mark on the northern shore of Takou Bay
(35°03.80′S 173°55.70′E); then proceeding along a
straight line in a north-easterly direction to reference
point (32°36.00′S 176°54.00′E) on the outer limit
of the exclusive economic zone; then proceeding
generally in a south-easterly direction along the outer
limit of the exclusive economic zone to reference
point (33°09.00′S 177°39.00′E); then proceeding in a
straight line in a south-westerly direction to reference
point (35°13.34′S 174°05.73′E); then proceeding in a
southerly direction to reference point (35°16.88′S
174°06.31′E); then proceeding in a southerly direction
to the southern headland of the entrance to the
Haumi River (35°17.86′S 174°06.19′E); then
along the mean high-water mark to the point of
commencement. The geographical coordinates named
are in terms of the WGS84 datum.\n
3. Cancellation of appointments—On 14 February 2008,
the Associate Minister of Fisheries, under Regulation 10(1) of
Fisheries (Kaimoana Customary Fishing) Regulations 1998,
cancelled the appointment of the late Keith Ashby and
Remarie Kapa as Tangata Kaitiaki for managing customary
food-gathering within the area/rohe moana.

Nomination of Tangata Kaitiaki—Te Komiti Kaitiaki
Whakature i ngā Taonga o Tangaroa, on behalf of Ngā Hapū
o Taiamai ki Te Marangi, has nominated Monica Ashby
(Ngāti Rangi), Arena Munro (Whitiora Marae), Maureen
Napia (Tauwhara Marae), Mana Paul (Te Whetu Marama
Marae), Hugh Rihari (Ngāti Torehina) and Puke Taituha
(Oromahoe Marae) as additional Tangata Kaitiaki for
managing customary food-gathering within the area/rohe
moana.\n -
Appointment of Tangata Kaitiaki—On 14 February
2008, the Associate Minister of Fisheries, under Regulation
9(1) of Fisheries (Kaimoana Customary Fishing) Regulations
1998, confirmed the appointment of Monica Ashby (Ngāti
Rangi), Arena Munro (Whitiora Marae), Maureen Napia
(Tauwhara Marae), Mana Paul (Te Whetu Marama Marae),
Hugh Rihari (Ngāti Torehina) and Puke Taituha (Oromahoe
Marae) as additional Tangata Kaitiaki for managing
customary food-gathering within the area/rohe moana. -
Confirmation of tangata whenua—Ngā Hapū o
Taiamai ki Te Marangi is confirmed as the tangata whenua
of the area/rohe moana to which the appointment of Tangata
Kaitiaki relates. -
Power to authorise the taking of fisheries resources
for customary food-gathering—A Tangata Kaitiaki may
authorise any individual to take fisheries resources managed
under the Fisheries Act 1996, other than those resources that
are taken in fresh water, for customary food-gathering
purposes from within the whole or any part of the area/rohe
moana. No customary food-gathering of fisheries resources
may take place in the area/rohe moana without an
authorisation from a Tangata Kaitiaki.

Regulations 1999
Fisheries (Declaration of Mātaitai Reserve at
Puna-wai-Tōriki (Hays Gap) and Appointment of
Tangata Tiaki/Kaitiaki) Notice 2008 (No. F434)
Pursuant to Regulations 20, 21 and 22 of the Fisheries
(South Island Customary Fishing) Regulations 1999, the
Minister of Fisheries hereby gives the following notice.
Notice
-
Title—This notice may be cited as the Fisheries
(Declaration of Mātaitai Reserve at Puna-wai-Tōriki
(Hays Gap) and Appointment of Tangata Tiaki/Kaitiaki)
Notice 2008. -
Commencement—This notice shall come into effect
on the 28th day after the date of its notification in the
New Zealand Gazette. -
Interpretation—In this notice:
(a) "mātaitai reserve" means the identified traditional
fishing ground described in clause 4 of this notice.
(b) "Tangata Tiaki/Kaitiaki" means any person or
persons appointed as Tangata Tiaki/Kaitiaki for the
mātaitai reserve under Regulation 21 of the Fisheries
(South Island Customary Fishing) Regulations 1999.
- Declaration of a mātaitai reserve—The Minister of
Fisheries hereby declares a mātaitai reserve over
Puna-wai-Tōriki (Hays Gap) – the area between Tirohanga
and Campbell Point (O-waea), near Kaka Point, Southland.
The mātaitai reserve encompasses all coastal waters enclosed
by a line that:
(a) commences at the mean high water mark at Campbell
Point (O-waea) (169°47.92′E 46°24.73′S); then
(b) proceeds eastward to a point (169°48.60′E
46°24.75′S); then
(c) proceeds southward to a point (169°48.61′E
46°25.58′S); then
(d) proceeds south-west to a point north and west
of the breakwater at Tirohanga (169°47.74′E
46°26.15′S); then
(e) proceeds northward following the coastline along
the mean high water springs to the point of
commencement.

Appointment of Tangata Tiaki/Kaitiaki—Edward
Ruffell, Mary Johnstone and Malvern Cain are hereby
appointed as Tangata Tiaki/Kaitiaki for the above
mātaitai reserve. -
Commercial fishing prohibited area—Commercial
fishing within the above mātaitai reserve is hereby prohibited
under Regulation 24 of the Fisheries (South Island Customary
Fishing) Regulations 1999. -
Power to authorise taking of fisheries resources
for customary food gathering—The Tangata Tiaki/Kaitiaki
may authorise any individual to take fisheries resources
managed under the Fisheries Acts 1983 and 1996 for
customary food gathering purposes from within the whole
or any part of the mātaitai reserve. No customary fishing
may take place in the mātaitai reserve without authorisation
from the Tangata Tiaki/Kaitiaki.
