Explanatory Note
This note is not part of the instrument but is intended to explain its general effect.
This instrument, which comes into effect on 3 November 2008, amends two ministerial welfare programmes under the Social Security Act 1964, the Home Help Programme and the Away from Home Allowance Programme, to exempt certain payments from affecting a person’s eligibility to assistance under those programmes. These programmes concerned link eligibility for assistance to eligibility for the community services card or the family tax credit, which may be affected by the payments made.
The new exemptions apply to compensation and ex gratia payments made by the Crown to a person in recognition of harm or in respect of a claim of harm and to specified payments made to a person by the Viet Nam Veterans and Their Families Trust. The exemptions are limited to 12 months from the date of payment.
The instrument also updates references to family support under the Income Tax Act 2004 to the family tax credit under the Income Tax Act 2007.

Notice of Approval Given Pursuant to Section 160(3) of the Crown Entities Act 2004
Pursuant to section 160(3) of the Crown Entities Act 2004, I, Jane Meares, Treasury Solicitor, hereby give notice that on 20 October 2008, The Honourable Dr Michael Cullen, Minister of Finance, and The Honourable Chris Carter, Minister of Education, gave approval under section 160(1)(b) of the Crown Entities Act 2004, for school boards of trustees acquiring debt securities and redeemable shares issued by the Southland Building Society, subject to the following conditions:
(a) The Southland Building Society’s credit rating by Fitch Ratings does not fall below the existing level of “BBB”;
(b) the Southland Building Society complies with its conditions of registration imposed under section 74 of the Reserve Bank of New Zealand Act 1989; and
(c) the Southland Building Society notifies Crown entities and organisations named in Schedule 4 of the Public Finance Act 1989 that hold debt securities and redeemable shares issued by the Southland Building Society as soon as the bank becomes aware that it is unlikely to comply or no longer complies with the preceding conditions.

Statement of Indemnity Given Under the Public Finance Act 1989
Pursuant to section 65ZD(3) of the Public Finance Act 1989, the Minister of Finance makes the following statement:
“On 15 October 2008, The Honourable Phil Goff, Associate Minister of Finance, on behalf of the Crown, gave an indemnity to Te Wānanga o Raukawa in relation to any income tax or GST which may be payable in respect of the settlement amount under the Deed of Settlement in Relation to the Wānanga Capital Establishment Report (Wai 718) dated 15 October 2008.”

This notice is supplementary to, and is to be read together with, the Commerce Act (New Electricity Information Disclosure Requirements) Notice 2008, which was published as a Supplement to the New Zealand Gazette, 31 October 2008, No. 165, page 4317) (the “Principal Notice”).
